Jautporn to Take Debate Stage at 8 P.M. Tonight

Red shirt leader and Pheu Thai Party List MP Jatuporn Phrompan will participate in today's censure debate at around 8 P.M. tonight.

He is expected to be the high light of this no-confidence motion and will be focusing on the government's alleged use of force in dispersing the red shirt protests.

I thought that this guy was in custody, so how come he is being allowed to appear on TV to discuss a 'no confidence motion' regarding the Government? This is pure insanity and could only happen in Thailand. He should be in solitary confinement for his leadership in the destruction of parts of Bangkok.

So he is still an MP and this allows him to incite violence and the burning of parts of the Capitol city. Allegedly? Amazing Thailand.

Did I not read somewhere he is on a list of MP's that are in the process of being impeached.....just hasn't happened yet?

This immunity claimed by Nattahwut and other MPs is very strange in my view.

I understand that an MP has immunity for what he says or does as an MP in the parliament. But this immunity should not extend to his private life.

In fact, Art. 130 of the Thai Constitutions stipulates:

Section130. At a sitting of the House of Representatives or the Senate or at a joint sitting of the National Assembly, words expressed in giving statements of fact or opinions or in casting the vote by any member are absolutely privileged. No charge or action in any manner whatsoever shall be brought against such member.

This privilege or immunity is very restricted and does not even cover acts or words expressed during a broadcasting.

The Thai Constitution even contains provisions about the arrest of an MP:

Section 131. No member of the House of Representatives or senator shall, during a session, be arrested, detained or summoned by a warrant for an inquiry as the suspect in a criminal case unless permission of the House of which he or she is a member is obtained or he or she is arrested in flagrante delicto.

If an MP is arrested, the President of the House of Representatives my request his release. "May", not "has to". So someone obviously has requested the Red Shirt leaders, who are MPs, to be released. Right?
