Fiancee Visa Including Son To Australia

My fiancee struck a problem with her visa as she has an 11yr old son.The son will travel with her to Australia.

There has been no contact with the father since birth and they do not know where the father is, or even alive.

His birth certificate is in her own family name.

She has done what she can to get necessary paper work from the Thai Authorities & translated for the Embassy.

She has been told she might have to have a DNA test.

Does any one know where this can be done in Bangkok and the costs involved?

Stupid part about the whole senario is they have both travelled to Australia before on the same type visa.

Apparently the Immigration Law has changed because of unlawful removal of minors from Australia associated problems which is fair enough.

If any one can give some advice on this matter it would be much appreciated.

Just some thoughts as my missus brought her son over 10 years ago at same age.

Daughter too actually.

How is his english?Where you will live?Schooling etc.

It was very tough on the Missus and her kids,arriving here and being dumped into a school in Nth Sydney with little english.(she came over to live with her sister)

The son did well until about 16 then dropped out of school,daugther stayed at school and struggled on.

The chinese invasion hadnt started so it was tough for them to achieve at school.

You need to consider cost of extra tuition etc.

How is mums english?

The most detrimental thing I find is Both the Missuses kids hang around with thais ,speak thai here as pretty much first choice,and of course at home it was thai in the extended family that were here as well .They havent really integrated.

Just a consideration it may be easier on him and you to get him into a good school in Thailand ,get his english up to scratch and bring him over when hes a bit older??

Thanks SH,yes he has been to Australia before with his mother,thats where I meet her as her relationship broke down with her then fiancee.

He can speak some English and his mum can speak very fluent English.

He is having extra(paid) English in Bangkok in a private school.

I have seen exactly what you are saying about Thai kids right here in Brisbane.

They are no differant though from their mums,as they like to be with their own.

I believe that Sydney is a big place and has a few more problems than where I live out from Brisbane,as far as schooling thats not a problem,the problem is getting him the visa.

As for the DNA test, what do they hope to achieve?? One of my friend had a DNA test done on his child (to be sure) in Bumrungrad Hospital. They do not have the facilities but had to send the sample overseas....it took 2 months to get the results back. This was about 2 years ago, it could be faster now.

I agree with Snoophound's comments though. Visiting a country is very different from actually living there.

I don't know about the requirement for DNA tests, sounds a bit overboard to me.

But, TW's daughter was born in similar circumstances to the one you mention where the father did a runner shortly after her birth but to complicate things she was registered in his family book. To get her into Aus the 1st time we had to assemble the entire family (over 18) into the local Amphur Office, all at the same time which was a real challenge in itself, to write and sign Stat Decs stating that TW was the mother and sole supporter of the child. These then had to be translated and presented to the visa section with the other documentation.

No problems from then on all the way to Permanent Residency.

Thanks for your comments,just a few points,my last wife was Phillipine and lasted 23 yrs and I do realise the hardship of marriage kids etc as l had 3 children all grown up now.

As stated my fiancee between her last visit and this visa application Immigration laws changed and things have been made harder(i do agree with those laws) they are for all our own and childrens protection.

What I need to know, and or meant was if any one knows the procedure of proving that she has sole custody and is the mother, other than DNA? which has been mentioned,being the last straw.

Most immigration problems are basically simple but when you get a Government like we in Australia have and to prove that point have a look at the mess they are in.

To me this Forum is the best and some very good advice and information is found here and possibly more help than you will ever find in an Immigration office in Bangkok.

thanks Ski,by god I think youre correct,my Fiancee says Honey be patient because that I have been to Australia before they are making sure we do everything correct and they take their time as to make sure she don't come back again,even though circumstances were beyond her control and now thats why the department of immigration use a Discretionary Assurance Of Support to stop what she went through last time she was here,I think that is why they are making it hard for her.

Thanks mate thats the information I needed,thats exactly what my love one did,took her mum to the Amphur Office and had the stat Decs translated and sent them to Visa Office with some other documents.

She was lucky in a sense that her sons birth certificate was in her family name as he done a runner also.

As I said before the information that one can get from other guys like your self is great,thank you.
