Hi everyone ,

Want to start buy saying thanks again to all the people giving advice on this forum. It has helped me successfully get a Tourist and a settlement visa.

Me and my wife have been living in the U.K now for 12 months and are returning to Thailand next Sunday. I started making two settlement visas today for her daughters and suddenly got stuck on the sponsor questions.

Will i be the sponsor like i was for my wife ? or do i put my wife as the sponsor ? She works as a nail technician so gets paid in cash daily... I get paid much more on a salary so think it would look better ?

When i add the supporting documents ( a slightly edited version of robs settlement guide ) do i put down all our income and out goings for me and my wife combined and list us both as sponsors and just myself on the VAF4A ?

Sorry for the silly questions i have tried searching !

I'm no expert on this area but went and looked through some documents I've bookmarked because I can foresee my brother having to deal with this problem sometime soon.

I believe you need to give serious thought to the contents of Sewction a and Annex M of the UKBA Immigration Instructions relating to family members, see link below. There are lots of descriptions and definitions, also some examples of who might be the parent (i.e. sponsor) responsible for the application. I can't apply these to your circumstances as, I'm sure you will find out, much depends on the background of the two daughters.

HI ,

Ive got a few more really silly questions !

When doing two visas at the same time will one person do them both or do you have to plan that the visas to be done seperatly ? It's going to be a pain getting 10 photo albums re-printed otherwise!!

And do i have to include all the previous stuff from my wifes settlement visa ? Like relationship history , Hotel receipts , where and how we meet etc etc , Flight details from a few years ago or will all that not be taken into account seen as my wife got her settlement over a year ago ?

Hi Chris,

You can both sponsor each child. so one Settlement Visa form for each child. List joint incomes, also that you have accomodation for them, also that you are settled I.e Rent / Mortgage agreement / utility bills or letter from parents proving they house you and have seperate room for them You must provide same as before, 6 months bank statements etc.....

Most important of all is that your wife makes the daily decisions concerning the control of her children, also proving your regular contact exercising that control (tel bills - PC bill) emails etc.,

I've just done the same for my step-son. You have to (MUST) cover such points as who has custody of the children while you were in the UK, family connections, there is not an automatic right for the UKBA to grant settlement to the children unless you come up with special reasons, see recomended site on previous post for research.

I think ive got enough to proof it. Have included things like :

A letter from the School

Reports done from the School 4 years ago , agreeing that the children had no father allowing the children to receive some sort of money/benefit ?

A letter from the boss of the village stamped in the office

A Por Kor 14

Letters from the private school we send them too and telephone records to the teacher when we discussed the courses and what they included.

A letter from the dad done at the office saying hes never spent time with the children or helped them in anyway

Letters from close family

All the Bread statements showing us sending money every 4 weeks.

Daily telephone calls etc etc..

Ive included information in my cover letter/photos showing us building the flat we now rent. And my wives college certificates and now current work receipts.

My wive has been in the UK since November so i will say we've spent the last 1 year getting a place ready for the children and getting my wife a job and car etc.

The real father of the children is actually a man from Japan , But he wasn't around when the first child was born so my wife used her friend to sign as the father as she didn't want the birth certificate to be blank. She then got pregnant again 2 years after and the relationship ended before the second child was born so her friend signed his name on the birth certificate again.

Im basically going to say that the friend was the dad and that him and my wife had a on and off relationship but he has never spent time with my wife or seen the children after the second child was born around 7 years ago. I think this is the most straight forward and easy option ?

You seem to have covered everything.

Oh, what a tangled web..........................

Normally I would advise telling the truth in a visa application; but given the circumstances as you have described them I think you are right to keep things simple and as this man is named as the father on both birth certificates go with that.

However, as far as the embassy will be concerned he is the father, so, whilst not essential, it may be an idea for your wife and him to go to the ampur so they can both sign a document granting her sole custody.
