Hello everyone,

Having scoured the forums and being unable to find an answer specific enough I was hoping I could get some advice.

I am currently in Thailand on a single entry non immigrant b visa on which I am admitted until the 1st november.

Now the plan was to apply for the work permit, however, complications ahve arisen and the paperwork will not be ready 14 days before that date (I read this is the typical processing time for work permit applications). Can anyone advise as to what options are available to me?

I have read on websites that with certai types of visas (Confused) you can report to thai immigrant and fill out a form and get 90 days extension with minimal paperwork and hassle? Is this possible with the non immigrant b? If so, what, if any, paperwork is necessary. As i said before paperwork from this company is going to be impossible to come by for the remainder of the stay (HR manager resigned/Owner out of the country etc.)

Failing this any other suggestions would be welcomed

No extension of stay possible (only the ED (education) entry has such a provision and only with proof each time of school attendance.

It is not clear what you mean with the 14 day comment. Will you have paperwork from company to allow a new visa issue at the end of your current stay? Or not? If you have you can just exit and obtain a new non immigrant B visa (although it helps to have the work permit application made and receipt with you) but with no paperwork; much less a work permit, another B visa would not be issued so the best you can hope for is a tourist visa for a 60 day stay and when things get together apply for a work permit and then make another visa trip to obtain the B visa and return to have the work permit issued.

The 14 day was merely a reference to something I read, the paperwork would not be ready until after the end of my admitted stay meaning, unless I can get an extension to stay, I will need a totally new visa? Usually on tourist visas you can extend your stay just by turning up at the immigration bureau. Is this not at all possible with the non b?

Not unless you meet the conditions - for a B visa that would be work permit and income depending on your nationality of about 50k per month plus company meeting conditions to allow the extension of stay (not all do). Otherwise you have to make 90 day border or visa runs.

Thanks for the swift replies.

I found a TM47 form it has 2 checkboxes, 1 for tourist visa and one for non immigrant however, it does not say which type. Does this apply only to the O-A visa or the B category as well?

What about the TM7 form?

A TM47 has nothing to do with you. It is used for address reporting when here longer than 90 days (which you will not be). After you obtain employment and extend your stay is when that becomes part of your plans.

The TM7 is used for any extension of stay so you will use that in the future if you qualify. Currently the most you could get with it is a 7 day period to leave and that might also require tickets out which I do not believe you have. It might be an option if you were sure about when paperwork would be available and that you would qualify for a longer extension of stay. But that does not seem to be your situation.

Hmm, Ok I understand.

I am still confused however. On this website that in order to get a work permit I need to submit the following:

EXAMPLE OF DOCUMENTS FOR WORK PERMIT

- Form WP2

- 3 x recent photos; 5 x 6 cm

- Letter of employment

- Copy of company registration certificate, including objectives.

- Copy of shareholders list.

- Copy of VAT registration; Phor Phor.01

- Organization chart

- Copy of front page of passport and visa.

- Education certificate and resume of previous employment.

- Health certificate

- Map of place of business.

- Photos of Office inside and outside, with outside showing the company name and address.

Hypothetically speaking, if I was to get this done. Would they extend my stay or am I still only allowed to stay until the date stamped on my non immi b? In which case I would have to produce the following documents to extend the non immigrant b for 1 year:

EXAMPLE OF DOCUMENTS FOR ONE YEAR EXTENSION

- Copy of applicant's Passport and Original.

- 1 x recent photos; 4 x 6 cm

- Copy of applicant's Work Permit and Original

- Original Company affidavit and Shareholder list (updated within the past 6 months) certified by registrar of Ministry of Commerce.

- Copy of the company annual audit, P.N.D 50 and Sor.Bor.Chor 3 of the latest year, certified by Revenue Department or Ministry of commerce.

- Copy of the company's monthly personal income tax (PND.1) for the 3 previous months (certified by Revenue Department) which shows all employees including names of foreign employees.

- Copy of annual personal income tax (PND.91) of the latest taxable year which must be certified by Revenue Department with an original receipt. (If any)

- Copy of Por. Por. 30 of the 3 previous months which certified

- A map of the company's office location

- 6-8 photographs of the company showing the building and location of office including its nameplate and number and showing the employees working during office hours.

- Copy of Social Security Fund return of all employees (Sor.Por.Sor.1-10), of the 3 previous months which certified.

It seems to me if i understand this correctly. I have to get the work permit receipt/approved, and then extend my visa all before the 1st of november, without any extensions?

I am pretty confused when it comes to the laws with these two things, as they are interrelated.

I also found this link if it provides any relevance? I am not sure this source is at all credible, but they say nothing about documentation to extend other then the 1900 baht fee and forms
