Featured Replies

Well folks , your worst nightmare has come true!!I mentioned a couple of months ago, a new debt collection agency was coming to Thailand, they are already here in Oz, I put my house on the market in brissie , while we were in Thailand squatters vandalised it!! the courts could not help us or the police, but this company, got everything sorted out of court for us ,they are not cheap, but they getyou your money or property Back, Watchout, Bayside is coming. Nignoy :o

Yes I can just imagine it. Two big, beefy, hard-nut strong arm boys going to a remote village in Thailand to 'get' a Farang that owes a couple of quid.

I can also imagine the headlines next week;

" Police find van that went missing in Isaan, resprayed and for sale in BKK. No sign of previous occupants' :o

but this company, got everything sorted out of court for us

So whats new. :o TiT, sorting things out of court is standard.

and effective :o:D

Yawn

Seen this kind of thing before - my business partner in the UK took out a loan on our joint account. The bank gave it to him without even contacting me (I didn't even authorise an overdraft, let alone a loan) & then started chasing me when he buggered off.

I got letters from an international debt collection agency - they had my address in Bangkok (I gave it to the bank freely) but there was bugger all they could do.

It's called juristiction. They don't have any.

Don't tell me that they are going to be 'leaning' on people out her 'cause if they do - they'll last 5 minutes.

You have been unwarned - they'll send letters & call you up but there's bugger all they can do....

I'm not scared ...... :o

totster :D

I'll hide behind you then :o

According to friends in Samutprakarn thiscompany are working with a thai based german company, who have been operating in thailand successfully for 7 years, they supposedly have the support of some govt and police officials, so we can only wait and see what happens, remembering that next to Australia, Thai Police and Burocrats are the best money can buy :D nignoy

Vast difference between fraud and debt. One illegal, one not. As far as I can see it would be much easier to deal with law breaking i.e. vandalism in Australia or Thailand, than debt recovery. These guys have no more powers than anyone else and are much easier to get restraining orders against. In fact the beefier they are the easier to get a Court Order :o

best I return my overdue library books, pronto :o

If you've had them more than 5 years this could be construed as theft and you can expect an imminent visit from " The Library Policeman" :D

This type of service has been available for years, decades, in Thailand – run by Thais, who are not at all concerned about “jurisdiction” or other legal niceties as this Western Company will be.

Called “Reng Rat Nee” in Thai, their methods can range from a polite request for payment all the way up to physical violence and even murder.

Not at all difficult to find and definitely not the sort of people you would want to have on your back – the Western Company will be a babe in the woods in comparison.

.......Vast difference between fraud and debt. One illegal, one not..............

Interesting, if it is fraud, you would have to be charged and convicted of that offence. I am sure the local authorities would be happy to escort someone convicted of fraud to the airport etc.

If its only a charge, then the debt collectors would only be able to apply for your extradition, to face such charges. With a good defence team, people should be able to beat the extradition order. Obviously for a serious fraud, people should be extradited to pace what awaits.

As for a debt that is not fraudluant, the debt collectors would only be able to serve notice on you. Knowing the dubious business practices of these agencies, I am sure they would be putting all sorts of people on a commission to assist them with getting debts repaid.

I saw an 80-year old Grand mother lose everything including her house, retirement savings personal effects because she agreed to be a guarentor for a loan for a relative who killed himself. I am sure the debt collectors felt good about turfing out an old grannie onto the street.

I certainly feel sorry for those who have lost money in loans etc etc, and their right to have their funds returned. Its just the debt collectors who are low-life scum and they have seen another avenue to make money.

If you were convicted of fraud "in abstencia" by living in Thailand there would be a warrant and it would be relative to the seriousness of the charges if extradition would follow. The Debt collection Agency would not be able to bring charges only the original Company/Individual. The Grandmother you mention would have had civil action taken against her by the Agency for non-performance. However without knowing all the facts, and not knowing what Country, any decent lawyer would not have let this happen. Reasonableness is taken into account by the Judge irrespective of the law.

There are indeed Debt Collectors who are low life scum, but other than in Countries such as Thailand, most now have to follow the law or end up in far more serious problems than those they are trying to get money out of :o
