Visa Problem

Featured Replies

Dear All,

I am asking this question on behalf of a luk kreung friend.

He is born to a Thai Mum. Has a Thai Child but not legally married to his gf. Is there any kind of visa that is available for him to take care of his child here in Thailand on a long term basis.

Thanks

If your friend has a Thai parent he is entitled to Thai citizenship.

Yeah i agree. But the problem is his country doest allow dual citizenship. And Permenent Residency is a pain in the butt to get.

Can he get a non O for supporting his child or something ?

Any advice greatly appreaciated

I take it he was not born in Thailand and never obtained a report of birth from the Thai embassy in his second country and has a reason for not claiming his Thai citizenship right. If he were on a home register in Thailand it is very easy to obtain one year extensions of stay on that basis alone.

There is an extension of stay available with the same financial requirements as marriage but if children are young it might involve court action to legalize his position as father (birth certificate alone does not do that).

Check to be absolutely sue that his country doesn't allow dual citizenship. A lot of countries don't allow it, but have exceptions. For example when one has dual nationality by way of birth it is often allowd.

If at least one of thechildren is older than 6 or 7 years he can try to legalize the child at the amphur. To do that both mother and child must agree, it is a very simple process but because the child must also agree most amphurs will not allow it till a child is at least 6 or 7 years old.

Lopburi, care to explain more on the home register thing? I think it might work for my dear friend.

Thanks alot buddy.

The blue book every Thai is listed on. Every home has such a book and those that live there are supposed to be listed in it - often long after they move on they will still be on a family members book rather than taking the time to enter themselves on the book for where they actually live but that is another story.

what nationality is your friend?

Technically he is already a Thai citizen due to birth from a Thai parent. He just doesn't have any offical documents to say that.

If he was to get a Thai birth certificate issued by the embassy in the country of his birth, he could use that to get a one year extension of stay in his normal passport.
