I am currently on a Multi B Type Visa and have a work permit. I have also just got married and my wife is a Thai National.

If for some reason I lost my job/resigned etc I persume that I would have to apply for an O Type Visa based on the grounds of marriage.

My question is would I then have to depart the Kingdom every 90 days or can I stay in Thailand ? I need clarification of the 400K as I have looked at many explanations and to be honest am a little confused.

If someone can explain the procedures and rules I would be very grateful.

Providing you can meet the requirements every year (400k etc) then you will not have to leave Thailand..........your inital Non Imm O based upon marriage can be extended to provide stays of 1 year ad infinitum.

Only requirement would be to report every 90 days to local immigration.

I do not have any capital outside Thailand but I have enough money here so can I still prove that I have 400K every year in my Thai Bank Account or does the money have to come in from overseas......

Will just add that 400k must be sourced outside of Thailand if you do not have a job here and a work permit.

If you can not meet requirements you could still obtain a use a multi entry non immigrant O visa on the basis of your marriage and cross a border every 90 days and make a trip every 15 months or so to Penang for a new visa. Perhaps not a great way to live for the long term.

Please also be aware if you have a work-permit and you satisfy the minimum income requirement - I think from memory its about 65k a month, you can get a 1-year extension on your Visa/entry permit.

It comes down to how much tax you will pay. I cannot remember the minimum. the MOL will tell you.

I have done it myself, they were not interested in anything from the bank, rather the statement from my employer saying how much they were paying me - and in turn how much tax I am paying.

The 400k extension is generally of use if you aren't working.

He would only need 40k per month on a support Thai wife extension of stay.

I have couple O-Visa question:

If thai wife runs her own restaurant business earning income say 20k/mo is the 400k/pa still required regardless?

Do the conditions for O-visa change once husband is over 50yo?

The 400k is required for any extension of stay for support Thai wife. There is no "support from Thai wife" extension of stay provision. And even though it might be considered in special cases I don't believe 20k would be anywhere close to enough. But that is just my guess. You would have to talk with immigration at the time to be sure.

Over 50 the same 400k requirements remain (for extension of stay).
