Non Imigrant Visa B For 1 Year

hello!

i have a big problem. i was working for a thai company from oktober till may 2011. shortly before i was leaving the country i gave back my work permit. (because of the tax)

i was entering the country with an non imigrant visa B single entry. afterwards the company arrange everything with the work permit and the extension of the visa for 1 year.

(without visa runs, and 1 re-entry permit)

so i leave the country in may.( the visa will expire in the middle of december)

now i would like to work for this company again. i will be back in thailand at the beginning of november.

now i want to know: is it possible to use this visa again because i have 1 re-entry permit and the visa is not expired and there is also no stamp on it that the visa is used.

is it possible to go back and the company is applying for a new work permit and after they renew the visa?

Did you apply for a re-entry permit before leaving the country? If not, not only the visa cannot be used any more, your work permit will be cancelled too.

I am surprised that there is no "used" stamp on your visa, but the immigration computer will show that it was used.

If you do have a re-entry permit, your visa and your work permit may still be valid, depending on whether or not it was reported that you quit the job when you left. You are obliged to report when you leave a job, but of course you can have been on a lengthy business trip. In that case, you need to know that you will be expected to pay income tax, as you were employed all the time. The company will be fined if they didn't transfer the income tax and social security for the time you were abroad.

we maid a report that we cancel the work permit that i don´t have to pay the tax when i am not in thailand.

and yes i have a re-entrypermit. that is the reason why i don´t have the stamp with used inside my passport

but now my question is: is it possible to use this visa again or did i loose my visa when i cancel the work permit? (expiring date is the middle of december 2011)

if i loose it i have to do the whole visa process again.

if not i can go back to thailand with this visa and the company have more than 1 month time to apply the work permit and

i can extend the visa for 1 more year.

Your extension of stay ended on your last day of work (regardless of when the work permit was returned) and you were required to cancel that extension of stay that day and leave within 24 hours. It appears you did not do that but may have just departed? If not you also have overstay that was not paid so would highly recommend you obtain a new visa for entry. That extension of stay is not valid.

Are you on a visa or an extension of stay? I am a bit confused here. If it is a visa, it should still be valid; if it is an extension of stay, you should have cancelled it the moment you returned your work permit.

From your first post, I understand you are (were) on extension of stay, this post mentions a visa. Kindly clarify. If you are not sure of the difference, please post a copy of the stamp here that says it is valid until December.

i just had a look inside my passport again. it is an extension of stay. the validity is till the midle of december.

on the same day when i gave back my WP i leafe the country. that was the reason why the man on the border was not able to

see that i don´t have an WP.

under the extension of stay i have an re-entry permit so he didn´t stamp it with used.

what would happend if i try to enter the country with that re-entry permit. would the man on the boarder see that i don´t have a WP at the moment?

if he didn´t see it. it would be possible in this time to get the WP back and extend the visa.

if i apply for a new visa and work permit will it be more dificult than the last time or the same because i gave back my WP before it expired.

or it doesn´t a matter?

You were required to cancel that extension of stay and if you return using it that will likely come to light when you attempt to get paperwork for new job and could then be a case of illegal entry if they care to pursue it and deportation. You admit not paying tax so hard to argue you were still employed.

I would obtain/enter on a tourist visa (if they will issue - you did not cancel your extension/re-entry so it could be seen as having a valid visa for entry by Consulate - but the worst that can happen there is a no) and then obtain a new non immigrant visa for work permit issue when the time comes.

did i understand it right?:

it could be possible to enter the country with that extenson but if i apply for a new workpermit i can have big problems. in the worst cas they deport me?!

so now i should obtain a tourist visa if the man on the border say no about the extensoin of stay i should enter with the tourist visa.

because with that visa i can obtain a new non immi visa and the work permit. and if i can enter with the extension and if they say it is illegal wenn i apply for the work permit

i can say you can see i have a tourist visa. is it right?

You cannot legally re-enter on that pemisison to stay, athough the chance of finding out is small if you don't apply for a new WP. Get a tourist visa and stay legal to avoid any problems.
