Consensual Divorce

Featured Replies

Iam seeking a consensual divorce in Bangkok, married to a Thai and we were married in Scotland (where iam from). Iam now resident in Bangkok and the marriage is registered in Thailand.

Iam aware of the process but there is one stipulation...that a letter from a UK body stating that this type of divorce is not violating UK law is required.

The embassy wont issue this and iam told that a UK solicitor letter wont work either. I believe it has to come from a goverment body

Does anyone know where such a letter can be found from in the UK?

:(

Have you thought of trying a UK lawyer. Perhaps he could notarize something for you.

You think something notarised would be accepted by the amphur?

On the same note, I am in need of a lawyer in Thailand to assist with a divorce from my Thai wife.

Any recommendations for a reasonable, understanding (e.g. on the blokes side) lawyer?

You got married in the UK

You need to get divorced in the UK

As if you get divorced in LOS then you are still married in UK as far as I've been told

But yes I believe it not to be the other way round.

This is what I was told by my solicitor when divorcing my evil Thai wife in the UK

Was married in Bangkok at an office there - so want to get divorced there. Any reasonable lawyers out there?

Yes I think you definitely need to handle everything within the UK for this.

Divorces in the court here stand. It is the office ones that are problematic.

If you and your wife are in agreement about a divorce, all you need to do is pitch up together at the Amphur, hand over your marriage certificates, sign a form and you are legally divorced, you don't need a lawyer.

If there is any dispute, then you need to go to court and of course you will need a lawyer. I'm sorry but I'm unable to recommend a decent lawyer, only one I wouldn't touch with a barge pole. The grounds for divorce are set in Thai Law.

Sorry if Im teaching you to suck eggs.

Divorces in Amphurs are perfectly legal, what's problematical about them?

Where did you try to get a divorce?

You can get a divorce at any amphur (called khet in Bangkok). The simplest solution might be to just go to an ampphur that is used to deal with foreigners and try it there.

As has been said, you don't need a lawyer, unless there are assets involved or you want a custody arrangement if there are children. If not, it is as simpe as getting married was.

Surely, if you marry in the UK, using UK law and procedures then you must divorce in UK ?

THe problem is that UK and a few other countries recogise divorces that are made in court., It does not recognise divorces that are done administraticely...ie in the ampher where both parties are not resident in the country...ie one or both has UK residence and is generally considered to be living there. This would also apply to divorces done by saying "i DIVORCE YOU" Three times even if this results in a legal divorce in the country in which it is done.

If both parties are resident in Thailand an administrative divorce is valid. A court divorce in Thailand is also valid.

I have been told by the UK and Thai lawyers that since we are both resident Thailand then divorce here is only option.

Also been told that it will be recognised if done through amphur. The problem is the amphur needs a letter from somwhere in the UK that states it doesnt violate UK law,

Does anyone know where such a letter can be found..eg goverment body or will a notarised letter from a UK lawyer work?

What amphur in Bangkok deals with foreigners as the one i went to, no one could speak word of English
