Overstayed First Entry On A Double Entry Visa

I messed up. My whole family is here visiting my uncle who lives near Pattaya. We got a 4 month visa at the LA Embassy. I did not even know about getting 30 day extensions on each entry to make it a total of 6 months until recently.

So, I arrived in April and was supposed to do a border run with the family in June. I thought I just had the privilege of double entry but didn't have to use it unless necessary, and I would get an automatic 4 months without any border run interruptions. Paid a lot of money to get it too when you times this by 6.

So, here it is at the end of my 4 months, it is the time I thought I would do a border run to make an extension for 30 days. My first entry is almost 2 months overstayed. I think by now we have already accrued the maximum 20,000 Baht for each Visa, which for us is x6- ouch!

Is there anything we can do? Should I just go to the immigrations office and see if they will help me out? Or should I get an immigrations attorney?

We have decided to get a 1 year Education visa and move up to Bangkok, but I am not sure how this overstay is going to effect our plans now.

Ouch.. that is 120,000 Baht in total ALOT of money. You will get better help at the Visa section.

Agreed, it needs to be moved. With any luck some of those family members may be small children so the overstay fine may not be as much, but it probably won't affect future visa applications.

I just find it difficult to believe nobody looked at the permission to stay dates entered into their passorts, and not get a clue there was going to be a problem.

I imagine what would happen is that you would have to pay the hefty fine, cross the border and then they will activate your second entry. :)

The fact that you actually have a valid visa should go a long way in showing that it was not a deliberate act. But it is going to cost you.

It won't hurt to call the Immigration Office in order to ask for advice. Personally, I think it's best to be at a border with cash in hand.

Perhaps someone else will have better info.

Go to immigration and see what they say. Are you sure your 2nd entry is still good there is a use by date on the visa. Before you start talking Ed visa get this sorted out and if on over stay they usually recommend you leave by the airport.

This situation just under scores the need for people to read the rules and understand them as to save them a great deal of money and time. Good luck.

No doubt about it, you are on overstay, at 500 a day with a maximum of 20,000 per person. There is nothing that can be done about that.

But I might have some goodnews: children under the age of 15 are not fined for overstay.

As said , 500 Baht a day overstay for adults.

Kids 14 and under do not get fined.

The Visa is valid for 6 months from issue date so the second entry should still be valid.

We went over to the immigrations office in Jomtien. They were kind and helpful. We have to pay the overstay Visa charge for us two parents- our children, all under 14, are not an issue.

First we will get a 30 days extension this week from immigrations.

Next, we will be going to the Cambodia border to check in/out and get an additional 60 days.

This will give us ample time to get our Ed Visas underway.

Other than the mega baht fines, glad to hear things went well with you at Immigration, and it is nice, now and then, to hear that Immigration isn't all that terrible.
