PAD Leader Again Seeks New Election

A leader of the People's Alliance for Democracy has once again filed a lawsuit with the court, demanding it annul the July 3 election and hold a new round of election.

Core leader of the People's Alliance for Democracy, or PAD, Major General Chamlong Srimuang, today resubmitted a lawsuit to the Supreme Court's Election Cases Division, demanding it nullify the July 3 election and order a new general election.

He claimed the poll was illegitimate as nearly two million voters, including himself, did not get a chance to cast ballots due to the fact that they registered to vote outside their constituencies in a previous election.

Earlier, the court rejected his petition, saying there is no law to empower one to annul the election results.

Chamlong said he resubmitted the petition as he viewed that all Thais should have the constitutional right to vote.

Meanwhile, PAD spokesperson Panthep Puapongphan stated that although the PAD's petition was earlier denied by the court, it decided to resubmit it as it has the right to seek justice under the Constitution.

Chamlong sues EC commissioners

Yellow shirt leader Chamlong Srimuang Thursday sued the five election commissioners for allegedly failing to ensure fairness in the July 3 general election.

In his petition filed with the Supreme Court's Electoral Cases Division, Chamlong asked the court to declare the election void and order the Election Commission to hold a new election.

He accused EC chairman Apichart Sukhagganond and the four other election commissioners of wrongfully applying certain provisions of the electoral law that resulted in more than 2 million eligible voters failing to cast absentee votes.

To annul the elections would go to far, even with this 'clearly Thaksin led' government. To sue the election committee seems a bit far-fetched as well I think.

Much better is pressuring the Election committee to propose to the appropriate organisation to amend the Election Laws to elaborate on absentee and pre-election voting / registration. As many said that time, registration for pre-election voting should be a simple one-off setting, automatically invalidated after the elections.

Agreed. And in addition to those possible amendments, i think the EC needs to lay down stricter rules for dealing with banned politicians playing a role in election campaigning, and for dealing with blatant lying in terms of promises made during campaigns.

PTP got away with what they got away with, during the last election, and if action was going to be taken, it should have occurred if not before the election, very shortly after. Now is too late. Changes should be made for the next election.

This political sector of the Thai people seems utterly incapable of accepting defeat -- on both sides of the divide.

Maybe it's because of the opportunities to grab wealth that goes with power; then again, many of them are rich enough already, but they're all moochers -- none of them knows the meaning of the word "enough."

It doesn't help move things forward in the slightest.

They shouldn't have allowed themselves to be shamelessly manipulated by Thaksin in the first place with their stupid vote no campaign. 6 million fewer people voted in the last election allowing Thaksin to win, good going guys

Seems to me that every person eligable should have been allowed to vote... its that persons right to have his or her say... if the election commision made the error.. there should be a new vote... f its a mistake in the law... amend the law... but if for some reason those peoples were denied their right to vote... start again... its all about Democracy... right?

It seems the Election Law is faulty regarding "pre-election". If you register for pre-election because you have valid reason why you can't vote during the (real) election, you are allowed to do so, BUT unless you undo your request afterwards you are supposed to EVERY time vote in the pre-election at the polling booth granted to you.

The law should be reviewed and amended (in my view).

To simple reschedule new elections would be terribly overdone, although the billions it costs and the other billions which are handed out would surely help the economy. We'd also see a whole new collection of campaign posters with 'campaign period only' promises ;)

Yellow-shirt leader Chamlong Srimuang yesterday filed lawsuits against five election commissioners, accusing them of failing to ensure fairness in the July 3 general election.

In his petition to the Supreme Court's Electoral Cases Division, Chamlong urged the court to annul the election and order the Election Commission (EC) to hold a new election. He also accused EC chairman Apichart Sukhagganond and the four other election commissioners of wrongfully applying certain provisions in the electoral law that resulted in more than 2 million eligible voters failing to cast absentee votes.

Chamlong had initially applied to the court on July 20 asking it to annul the July 3 election, but his petition was rejected on grounds that there was no law allowing an individual to seek invalidation of an election and for a new round of voting to be held.

Parnthep Puapongpan, spokesman for the yellow-shirt People's Alliance for Democracy, said that Chamlong had decided to take his case to court again after reviewing relevant legal provisions.

"As a plaintiff, he is convinced that he has the constitutional right to file the case, otherwise ordinary people would have nowhere to turn to if they lose their right to cast votes," the spokesman said.

It's all smoke and mirror about previously registering to vote outside his constituency and all that tripe.

The truth of the matter is he's embarrassed because his trusty PAD steed didn't get him to the polling station until a week after they'd closed.

Rules is rules even if they are apparently stupid. Why no one made any issue of this rule at all is more of a worry to me. The default state should be that you expect to attend your local voting station and vote. Does beg the question how many people have been disenfranchised over the years because of this rule, and furthermore, explains why so many migrant workers dare not to register to vote away from home.

Spot on! No vote means exactly that. And shouldn't this old, hypocritcal rabble-rouser be on the docks in court for not one uprising but SEVERAL!!!?????? He should clean up some of the dog S_IT he's left around the country!!!!! Old-aged child.....
