Abhisit opposes transfer of red-shirt prisoners to separate facility

Opposition leader Abhisit Vejjajiva disagreed with a move to transfer red-shirt leader Arisman Pongruangrong, other red shirts and prisoners charged with political-related issues, to the Lak Si holding centre - which has been specially prepared for political detainees - saying terrorism, physical assault and the use of firearms are criminal charges.

Director-general of the Corrections Department, Suchart Wong-ananchai, revealed the plan after Arisman turned himself in to police and failed to get bail.

Abhisit, the Democrat leader, said he was checking whose idea it really was. It has been claimed to have been proposed by the committee following up on the work and proposals of the Truth for Reconciliation Commission of Thailand (TRCT).

The follow-up committee is chaired by Deputy Prime Minister and Interior Minister Yongyuth Wichaidit.

It needs careful consideration, Abhisit said. It made sense that people accused of violating the emergency decree, such as for public gathering, would be transferred. But treating the red shirts, who allegedly committed crimes, would cause more problems in society.

Unless the plan was reconsidered, it would become "double standard", he said.

"The TRCT must come out and confirm if it was its idea. If the government goes on with its plan [to transfer the red-shirt detainees to a special prison], not only would it not bring about reconciliation, but it would also bring the country to chaos. One would do anything to get what one wants politically, without caring for the laws, and then claim it was a political charge. I agree with political expression but it must be within the law," he said.

Reacting to Abhisit's comment, TRCT chairman Kanit na Nakhon said that those who violated the laws during the political turmoil did that as a political violation. Although they are not political prisoners, they should be treated better than ordinary criminals so that the conflicting parties have good feelings towards each other.

"Changing the detention venue is for the government to decide. TRCT just proposes its opinions according to the principle, which was not meant to favour anyone," he said.

Kanit said his committee had proposed since September to prepare a special place for detainees on political charges.

It hasn't been claimed to have been proposed by the committee following up etc.

It has been presented as a recommendation by the TRCT, Recommendation 5.3.3 to be exact.

Recommendations - TRCT has presented recommendations to the Prime Minister on two occasions; the first regarding the use of chains on detainees and the second regarding fundamental rights of accused persons in criminal proceedings.

Further, the First Interim Report of TRCT contained eight recommendations.

TRCT would like to point out that although these recommendations were presented to the previous government, they were general in nature and not specifically addressed to any particular government. TRCT therefore requests that the current government take into consideration all recommendations made so far and proceed according to the recommendations in a concrete manner so as to continue to create a supportive environment for national reconciliation.

TRCT now has the honor to present further recommendations on important issues to the Prime Minister as follows:.........................

5.3.3 Accused persons and defendants are not villains or criminals as in regular criminal cases but are accused of committing an offence in order to achieve political goals.

Therefore, if accused persons and defendants are not granted temporary release, the government should arrange for their detention in an appropriate place, not in a common prison as has been the case in the past.

So no leaders then?

Arisman is a 'leader', not a 'member'. As is Jatuporn.

Jatuporn is free on Parliamentary immunity along with a dozen other Red Shirt Leaders who are now Pheu Thai Party MP's, while Arisaman is wearing a suit and silk tie to ride on the prison bus, while awaiting further transfer to the VIP Suite at the Country Club

He is the only Red Shirt Leader that is "detained", although loads of their rank and file minions are incarcerated.... at facilities that don't have stationary exercise bikes, I should add.

Oh i see. If you set something up, that means you are beholden to agree with anything they may say. i don't think so, especially when that thing you set up is now under the purview and influence of someone else who happens to have conflicted interests.

Oh i see. If you set something up, that means you are beholden to agree with anything they may say. i don't think so, especially when that thing you set up is now under the purview and influence of someone else who happens to have conflicted interests.

And to phiphidon, do you really agree with what the TRCT suggests? Crimes committed that have political motivation should be treated differently, including be sent to a "special" resort like detention center? An assassination attempt during an election should be treated differently too because after all, it can be politically motivated. It's so easy to read what the TRCT is suggesting at this point under this current government. They were manipulated somehow, perhaps with money, to whitewash and give special treatment to the Red Shirts only. The day Arisman decided to turn himself in, the TRCT came out with their statement, I mean why else? I hope next time there's unrest in Thailand, people start throwing bombs at each other and claim it was politically motivated and be sent to a resort. Hell, homeless people should be doing that.

He also said that "the findings of Kanit na Nakorn's panel will lead to national reconciliation" and that "he believed Mr Kanit's Truth for Reconciliation Commission would be able to provide the whole picture of what happened, so the government can form a reconciliation plan." in a 2 day seminar of the Democrat Party in Phuket that ended on the 1st August 2010" so he seems to have believed in it then.

The TRCT were not manipulated somehow "to whitewash and give special treatment to Redshirts only". The recommendation is for all crimes that are politically motivated, whether red shirts, yellow shirts blue shirts whoever are involved.

Your second comment about the timing of Arismans surrender and the report coming out is also erroneous. The idea of that the application of strict criminal law to demonstrators was inappropriate was made in the very first Interim Report of the TRCT which was released last April. A copy was given to Abhisit so it cannot have come as a suprise to him that the imprisoned Red Shirt demonstrators would be treated differently to ordinary criminals, unless of course he didn't read it.

Recommendation 5.3 above was expanded in the second TCRT report as recommendation 5.3.3.

You might notice in your last quote that it referred to "demonstrators" and it clearly refutes amnesty for those involved in violence. Why then do you extrapolate the leniency for those who broke the law by simply being there to those preaching and carrying out violent acts which lead to "grave losses of life and property"?

You highlight the section which suits yourself, but ignore the section which advocates prosecution of red terrorists. I doubt in the whole document is there any reference to holiday camp prisons for one side of the political divide as a means to achieving reconciliation.

Agreed. We couldn't let a single, instead of double, standard by the Red Shirts to occur.

They have enough to explain as to why the Red Shirt Leaders have an indoor running track, while their disposable minions doing their dirty work are confined in places like this:
