Hello,

I have been married to my wife for 6 years, we have 2 children who hold Thai and British passports, we are currently living in the UK but would like to one day move to Thailand where we have a house and about 10 Rai of rubber(about 500 good trees) which will be ready in a couple of years, we are also considering buying a small tractor to make some extra income.

I can get a Non Immigrant O visa and will probably have 400,000 Baht available for at least a year, my concern is that the 400,000 will eventually disappear and we might not quite make the 40,000 a month also the money we make from the rubber and the tractor would probably be cash in the hand rather than a taxable income.

I would like to know if there is any way of me extending the visa on the basis of my children being Thai, and not having the required financial requirements. If not can anyone tell me what the next best options would be to someone in my sitution. Any advice given would be much appreciated.

Lee.

Try checking [email protected] they have been very helpful to me.

the "la" in this addredd is cuz I'm in California USA, and deal with the consulate in Los Angeles, Ca. There should be a like address for your closest consulate as well.

I've got a lot of good advise in these threads too, but learned in these threads that the rules are constantly changing...the thaiconsulate can let you know the most current situation.

No the rules are not constantly changing, but different consulates and immigration officers choose to interpret them in their own way. The last serious change to entry was November, 2008.

To the Op, you need to understand the difference between "Extensions of Permission To Stay" and one year visas. You will be facing financial requirements for any kind of extension of stay, for wife or children. At this time, it should be easy enough to obtain a one year Non-Immigrant "O" Visa based on your marriage, no financial requirements are required many places. The visa would be valid for use for one year, each entry good for 90 days, at the 90 days simply exit Thailand and re-enter for another 90 days. If you re-enter just before the visa expiration, you can stay almost 15 months before applying for a new visa.

It is the extensions that is my concern, am I right in thinking that If I do not meet the financial requirements then I will need to return to the UK to make another one year visa, or are there any other options, I have heard that I may be able to get 90 day stamps rather than do a monthly border run, do you know anything about this?

You do not need to return to the U.K. to get another visa, apply at Savanakhet, Laos, they don't require any financial accounts, or KL, Malaysia only requires 100K.

Bear in mind that things do change and Consulates that currently issue Visas may not do so in a years time.

Also Consulates that currently do not issue may do so in the future.

There is always an option somewhere.

Also if thinking about 12 month extensions the money in the bank or monthly income must be yours and yours alone. Not joint.

If you are looking at Income from within Thailand you would need a Work Permit and all that goes with it.
