Non-B Visa For Staying To Be With Son

Hi all

I am 46yo Australian living here 10 years, I have a 2.5yo Son here going to school but am not married to my partner, thats planned this year.

I was on a Non-B as I operated a business with WP, now I am not wrking for health reasons and my Non-B finished last Oct.

I went on a visa run last week and got a 14 day visa.

Some freinds advised I can get a 12 month B type visa so I can stay in Thailand as my Son is here and enrolled in a school (Kajon Kiat in Phuket).

I cant find much information about this visa type anywhere so would value any input, such as

1. does it matter that my SOn in on Australian passport (he was born there)?

2. what docs are needed (I am told his Birth Cert, partners ID, letter from his school) ?

3. what is the cost ?

4. which embassies will issue it (I asusme any thats does a NonB/O) ?

Any help appreciated.

Is your Son Thai or Australian of both?

There are options depending on your answer.

To stay as supporter of a foreign student would require 500k in bank account for one year extensions of stay but not sure this would be accepted as/if mother is Thai and here and normally only one parent is considered adequate for this type of stay. With child on foreign passport entry the normal non immigrant O stay for Thai child would likely not be considered.

1. Yes it matters - he really should be here as Thai as that will open 60 day extensions and non immigrant O visa options.

2. There is no B visa option. For O visa you would need proof of study and copy of his passport I suspect as well are birth proof.

3. Normal visa costs. 2k single or 5k multi entry.

4. Do not know of any in area that will provide more than single entry (you are then expected to extend).

Believe you should get him here as Thai (exit by air and return on Thai passport) and then you can get single entry visas to visit and extend 60 days until you get around to marriage.

My above is based on child/partner being Thai but see you never said if they were or not.

sorry i forgot to mention he is 2yo, Australian PP only.

for this visa

- do I still need to show 500k in bank and 40k monthly income (as I read somewhere)?

- do i still need to do a visa run every 90 days (my non-b did not need this)

My partner and I plan to get married in MArch, both ceremony and on paper, but if it makes it easier

another option is to officially get married now for the Visa, we will still do our ceremony in march .

- is the Family Visa as flexible as the Marriage NOn O?

If your Thai girlfriend is the mother of your Son he is Thai also..

A Thai passport would make things a lot easier for him.

The extension lopburi was referring to needs 500 k in the bank.

You do not leave the country but report to Immigration every 90 days.

If you were to get married it would make things easier for you.

2.11 In the case of a family member of an alien who has been permitted to stay temporarily in Thailand for study in an educational institution as set out in clauses 2.8 or 2.9 (applicable only to parents, spouse, children, adopted child or the child of his/her spouse):

Permission will be granted for a period of not more than 1 year at a time.

(1) The alien has obtained a temporary visa (NON-IM);

(2) Proof of family relationship;

(5) In the case of parents, there must be an account deposit with a local bank made in the name of father or mother of not less than Baht 500,000 as shown in bank account transactions for the past 3 months. For the first year, it should have that said amount in the bank account for not less than 30 days at the submitted date of the application.

2.18 In the case of a family

member of a Thai(applicable only to parents, spouse, child, adopted child or child

of his/her spouse):

Permission will be

granted for a period of

not more than 1 year at a time.

(1) The alien has obtained a temporary visa (NON-IM)

(2) Proof of family relationship

(3) In the case of a spouse, the marital relationship shall be de

jure (legitimate) and de facto;

(5) In the case of a parent, one of parents must have an average annual income of not less than 40,000 baht per month or a money deposit of not less than 400,000 baht for expenses within a year.

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

Thanks for the help so far!

The only thing I am not clear on is the 400k deposit;

I can show > 400k deposited in my bank last year, but there is not 400k in there now.

Some other have said I need to show 400k in my bank 3 months ago.

And is this 400k needed for the initial Visa or for the renewal?

Can anyone shed some light on this 400K ?

The 400.000 has to be in bank for 2 months before every extension.

The money can not drop below the 400.000 during that time.

As said the money must be in account at or above 400k on date of application and for all of the previous 2 months every year.
