I have just opened my own company by myself with no problems... now I need a New Non-B visa. I planed to go to KL Monday to get it. I have emailed the embassy there to ask what documents they need but still no reply (4 days).

Can anyone here let me know what documents I will need to bring to the embassy in KL to get a non-b for the Thai company I just opened.

Most consulates want to see the company registration documents, minutes, financials, etc. But also within the region they want to see evidence that a work permit has been applied for.

You have to first make the Work Permit application at Labour before you go to KL. Once your papers have been successfullty filed with Labour, then you will get a WP3 Receipt which is an A5 slip of paper; you will then need to show KL a copy of this along with all the other company papers listed.

The WP3 receipt is accepted in lieu of the Letter of Approval; you can get a Letter of Approval from Labour, but it takes more time as it needs to be signed by the head of the local labour office.

KL are happy with the WP3 receipt and don't currently require the Letter of Approval; if all is ok you will get a 90 day single entry non immigrant type 'B' Visa.

You said it was required before you apply for a work permit and that is wrong. Only for the work permit to actually be issued is the visa required. You can apply on a tourist visa.

Ok I read again, I see what you mean.... I will not have time to get the WP applied for by Monday, I still do not have my VAT and Social done... only the company open.... Is it 100% nessesary for the Non-B at KL to have the work permit applied for or can they issue with just the company documents and a letter from Thai Partner?

You said it was required before you apply for a work permit and that is wrong. Only for the work permit to actually be issued is the visa required. You can apply on a tourist visa.

Kl normally require the Work Permit application to be succesfully filed with a WP3 receipt, plus the other papers listed, to accept an application for a Single 90 day Non Immigrant type 'B' Visa.

I have read on this forum that some have obtained a 90 day non immigrant B in Laos/Cambodia without the Work Permit receipt, but I do not know anyone personally who has done this.

I know they haven't answered your emails - but you could always try phoning the KL Consulate Visa section and see if they can help if you don't have the WP3 Receipt.

This is their list of requirements from the embassy website:

1. Visa application form duly filled out.

2. Applicant passport valid not less than 6 months. The valid of 18 months is required for one-year visa application

3. Copy of passport.

4. (4 x 6 cm.) Photograph(s) of the applicant, taken within the past 6 months.

5. Document required from the inviting company in Thailand:

  1. Letter indicating applicant’s name, passport number and the objective of the visit to Thailand, etc., requesting for Non-Immigration Type ‘B’ visa.
  2. Copy of employment contract indicating rationale for employing, his/her salary, position etc.
  3. Copy of the company’s registration.
  4. Copy of the company’s list shareholders.
  5. Copy of the company’s latest balance sheet.
  6. Copy of the company’s registration value-added tax (VAT).
  7. List of all foreign employees employed by company. (Specified by name, nationality and position)
  8. Map indicating the location of the company.

6. Letter of approval from the ministry of Labour (If any).

7. Copy of work permit (if any).

If your entry stamp is almost up, then one fall back is a visa exempt entry (15 days at a land border run or a 30 days by air) to make enough time to get your WP application filed, or a 7 day extension at your local immigration dept.

Please note that Labour are often not the easiest to deal with; you may need many visits there to get your paperwork straight, particularly if you are not using an experienced agent.

Just to let everyone know, a Non-B single entry visa was granted without the work permit documents. I included a letter explaining the situation (singed by my Thai Partner) and was nice to the lady and although they could not give the multi they were nice enough to give the single entry Non-B.

How long did it takes to get it?

I mean how many days?

I m exactly in same situation so I will prepare extra letter to explain that we cannot apply for work permit yet, no thai staffs yet hired etc.

I will try in Vientiane .
