Jomtien
If anyone of you has experience with it... I have to say that iam not very well educated at Thai Accounting. Simply said, we advertise parts of our business with adwords, we get billed by Google Ireland. Now as i understand, we need to pay withholding tax, but at what rate. 2% for advertising services or 15% for Profesional services abroad. Ofcourse we will call Revenue Dep. but if you of you had this at hand i like to hear. Many thanks. Peter
Sunbelt Asia
It is 15% but odds are high Google won't allow you to deduct it. You will have to pay it and then you have a higher amount as its 15% tax of the 15% ( additional Google income booked) you paid for Google. www.lawyer.th.com
Sumitr Man
I could be wrong, but isn't it 10% if a DTT exists? SM
Jomtien
Thanks for popping in guys, Sure i dont expect to get a refund by Google as my Bill comes without VAT. They dont charge VAT for companies outside of Ireland. So i also doubt that a Double Tax Treaty will help, but thanks for mentioning it as we will check that too. Jomtien
Ireland has no TAX Treaty with Thailand, as far as i can see. Revenue Dep. quoted (as expected) between 0-15% depending on the person on the line Maybe i let someone go the Rev. Dep. and see what they say.... Indeed it does not. http://www.rd.go.th/publish/766.0.html I also made some calls to confirm and even if it was thru the USA or Canada it would be 15% withholding tax. www.lawyer.th.com

You must know there really is no right answer, so take one you like and stop arguing. Put a memo in your file of when and where you were instructed that no withholding was necessary and act on that. If you're ever challenged, which is unlikely, you butt is covered against bad faith non-payment.
