Hi there,

I am changing my Employer in Bangkok and it has been told to me that I have to go Back India (as I am Indian) and apply for NON B Visa again to get new work permit, it said that i will need WP3 form to get new non B,

but today my new employer informed me that Labor Ministry rejected WP3 form as they told that WP3 form is in case when company hire a foreigner form outside of country not when the foreigner already working in country and have work permit ,

pleas let me know if its correct ?

You can try using form WP1 (or 2), one of which allows for an in country/personal application, if they wont accept a WP3 from your new employer.

Believe if old employer in agreement the new job/employer can be added to current work permit and then old removed after but in practice it is normally easier to obtain a new visa entry for most people (but perhaps not for you if you have to return to India).

Yes, this can be done, but certainly in my area Labour will not remove the first employer cited in the WP at a later date thus requiring the WP to be cancelled and the process started over.

However Lopburi has a point, because if you can add the second employer to your WP, you could then use your ammended WP, plus all the other company papers (probably for both 'employers'), to get the new One Year Multiple Entry Non B in India.

A 2.1 Extension of Permission to Stay with two employers in the WP is by no means easy and if Labour then insist the WP is cancelled to remove the first employer, then the extension is toast at that point.

The WP1/2 approach is still probably an easier route if Labour are being difficult about a WP3 application..

I already booked my tickets to India, anyone can confirm the list of documents i needed to get new Non B on my new employer ?

as in Thai Immigration website it shows i have to take WP3 form but now when i dont need it, then i am little confuse about the documents

You are obviously most interested in this section:

Letter of Approval from the Ministry of Labour. To obtain this letter, the applicant’s prospective employer in Thailand is required to submit Form WP3 at the Office of Foreign Workers Administration, Department of Employment, Ministry of Labour

This is where many get confused, as normally for speed what people take in lieu of the Letter of Approval is the Receipt for a successful WP3 Work Permit application at Labour (an A5 sized document); such a receipt can also be issed for a succesful WP1 or WP2 application.

Worst case you get the actual Letter of Approval which often takes an extra few days to produce as it has to be signed by the head of your local Labour Dept.

I strongly suggest you contact the Thai Consulate in India that you intend to deal with directly by phone, as their list of documents may well vary from the MFA list linked to above.

I have changed job from one company to another company in Thailand. It is very simple process. You have to get the tax papers from the old company as well as the copy of the old work permit document. The new company can apply using these papers and can get a new work permit. There is no need to go to India.

Btw, I am also an Indian.
