I am planning to marry Thai g/f in July. I already have the divorce papers translated and endorsed by the UK Foriegn Office and the Thai Emabassy in London. What else do I need to get visa for her and her son to come to uk after the wedding?

I also need paper work from her so I can apply school place for her son so I guess birth certificate for her son and translated copy and marriage certficate and translated copy. Any thing else. She is moving to the UK.

I made initial enquiries with the education authority and said apply one month before I expect her son to take up a place in a UK school. I am guessing if we marry 1 July everything can be in place for her to relocate to the UK end of Aug/early Sept. Is that reasonable?

Wishing you well...

Best place to start is here for the "Nut's 'n' Bolts" of the settlement visa for your wife and step son to be.

http://www.thaivisa.com/forum/topic/524561-uk-settlement-visa-basics/

You (or more to the point your wife to be) need to show they will have suitable accommodation and be able live without recourse to public funds, and for her son (assuming you are not the farther and he is not entitled to a British passport) will need to show the mother has sole responsibility and he is dependent upon her, fall down here is when a child has been living back at the village with grandparents or other relatives while the mother has been working and living away, the UKBA will expect such arrangements to continue.

Best of luck.

Not to forget you have to prove you are in a 'real relationship' with the lady.

Evidence of phone calls, holidays together, photos over a significant period of time.

No problem with proving relationship. Also she is a nurse. I will check out the sole custody bit. Currently son lives with her

Assuming that you can collect all of the required documentation and get an appointment at VFS, this page gives you some indication of how long it currently takes to process a Settlement Visa application. As of today, 22% of applications are processed within 15 days, 89% within 40 days and 100% within 60 days, so if your goal is to travel at the end of August, that's not an unreasonable expectation if you provide a complete application and satisfy the ECO of the bona fides of your relationship. Your wife also will need to show that she is free of tuberculosis and has passed an approved English language test that certifies her ability to speak and understand English at the A1 level.

And don't, of course, forget the fee of THB 82,600 for the visas (THB 41,300 for each applicant). There will be further charges for status changes once in the UK (e.g. conversion to ILR).

If she hasn't already done so, my priority would be to get the English test booked and sorted. Also the TB test just in case its not clear and she may have to go for sputum tests and cause a delay.

What's a sputum test? Her English is good, written as well. She is a nurse so I assume she gets all the tests going anyway.

If the xray is not clear or conclusive she may be asked to go back for daily sputum tests over a series of days before they will issue or certificate

Probably, but for the requirement of the visa she must provide a tb certificate issued by the IOM in Bangkok, the only place she can have it done. If she goes early to IOM to register she will get the cert the same day. She has to go to the IOM office to register, then she will be sent to one of two hospitals for the xray. Then its back to the IOM office whom will issue her cert if all is clear. It costs 2600thb (when my Mrs did hers anyway last year) and she will need her passport, ID and 2x photos

Why is a sputum test required to get a spouse visa. She has just been in the UK for 2 weeks. If she was positive then she was already here for 2 weeks and gone back.

^ Because any visa over 6 months and you have to prove you are clear of TB!

Have you actually read any of the information or links posted about getting a spouse visa?whistling.gif

Its not. I was just saying if the TB test (which is required) is not clear then she may be asked back to the hospital for further tests, possibly sputum tests, before the all clear is given.

As above anyone wishing to come to the UK, in your Mrs case those on a spouse visa, must prove that they are clear of TB. A TB test is not required for a short visit

Indeed.

James53, the post linked to by Basil B in post 4 (have you read it?) contains

Health and Language

Whichever of the above categories applied under the applicant will need to provide a TB certificate and evidence that they meet the basic English speaking and listening requirement; unless they are exempt.

As Razz says, any adult applying in Thailand for entry to the UK for a period of more than 6 months is required to provide a certificate to confirm that they are free from infectious tuberculosis. Follow the TB link above for details of how to obtain this.

Not sure what you mean when you say in your OP

I already have the divorce papers translated and endorsed by the UK Foreign Office and the Thai Embassy in London.
You are aware, I hope, that to marry in Thailand you need to sign an affirmation of freedom to marry in front of a consular official at the British embassy in Bangkok, have this affirmation translated into Thai and the translation certified by the Thai Ministry of Foreign Affairs in Bangkok.

This is requirement of Thai law and unless things have changed very recently, and nothing on the British embassy in Bangkok website nor the Thai embassy in London one says they have, any document you may have had endorsed by the UK Foreign Office and the Thai embassy in London (whatever that means) will not suffice.
