Hi to all, my fiancee is here in Australia on an engagement visa currently. She has found out shes pregnant. She wants to travel home to have the baby with her Mum and Sisters around for support and the support and comfort of Thai speaking doctors etc etc. Thats understandable.

My question is to anyone who has been in this situation,..what happens??

Will the baby automatically be eligible for a Thai and australian visa and be a dual citizen? and how this will work if yes.

Does this mean we will have to take the baby to the VFS in BKK?

My fiancee and myself will get married before she returns home.

Im sure there are a few here from Australia that have been in this situation and some help and avice would be greatly appreciated as to what the best way to do everything is and how it went for yourself. Please let me know!

Congratulations firstly!

When you say "engagement visa" do you mean a PMV visa (Prospective Marriage Visa) which has a validity period of 9 months and as you know you must marry before expiration of the Subclass 300.?

I may have to be corrected on this one, but I am under the impression that your good lady is only eligible for Medicare once she has applied for her Spouse Visa.

You should also be entitled to the baby bonus as well seeing you are an Australian citizen and father.

If this is the case, of course it will be more cost effective having your baby in Thailand.

Our lads were automatically given Australian citizenship upon birth and the same applied for their Thai citizenship both procedures were very simple.

NB Upon re - entering Australia with the baby you can then register him/her with Medicare.

From 1 September 2012, the amount paid for customers who claim and are eligible for Baby Bonus will be $5,000. The amount of Baby Bonus you can receive will remain at $5,000 until 30 June 2015.

The child will automatically be Thai because of the motehr being Thai.

If it will also be Australian will depend on wether you marry the mother before the birth or not. If not, you have to legitimize the child as yours (state before the law that the child is yours), so the legal father can be determined. How you actually legitimize the child will depend on in which country the child will be born.

Both countries have no problem with dual nationality.

Thanks Eddie. Yes mate thats the visa. Thats really good news on the double citizenship! I am yet to ring Immigration here in australia or the Thai embassy here as I figured talking to others that have been through this already are often the best source of information compared to my experience of talking to australian immigration who dont tell you to much unless you ask the question first (if that makes sense).

The baby bonus I hadnt thought about really until you mentioned it. I didnt realise a father could get it and furthermore a father of a child born overseas. Have to look into that one, good tip mate!

Hi, Im slightly confused by what this means? How you actually legitimize the child will depend on in which country the child will be born.

Not so sure you would qualify for $5k baby bonus if born in Thailand. However, depending on your financial status would qualify for applicable family support allowance

You will be married before the baby is born (according to your PMV conditions) so your name as the father will be placed on the birth certificate.

If you are unmarried at the time of birth, then it is another ball game.

As Mario has said both countries recognise dual citizenship and you can take the relevent paperwork to the Australian embassy for bubbs to be registered.

The Mum is Thai therefore bubbs is a Thai (also) on registration.

*Remember to keep all supporting evidence for your (Subclass 309 and Subclass 820 whichever is relevant )

Baby Bonus – is an income tested payment for each child born or adopted to eligible families. Baby

Bonus helps with the cost of a new baby or adopted child and is paid in 13 equal fortnightly instalments.

Before parents can be paid Baby Bonus they need to register (or have applied to register) the birth of

their newborn child with the state and/or territory registry. This is not a requirement for people whose

child is born outside Australia or has been adopted.

If you are claiming Baby Bonus, you must lodge this form within 52 weeks of the child’s birth

I suppose if Krisb marries directly in Australia then lodges the Sub 820 for a Spouse Visa , then Medicare entitlement is there automatically and the baby bonus if born in Australia.

To be eligible for Baby Bonus (BBY), a person,generally, must reside in Australia (i.e. Australia is their permanent home as demonstrated by intentions, family/property ties, travel patterns etc). There may be some instances where a person can claim FTB when temporarily absent overseas, if it is shown that Australia is considered to be the person's permanent home and they have a clear intention to return to live in Australia. It is therefore recommended that a person lodge a claim for payment, in order to test their eligibility.



The person must also:

  • be an Australian citizen, or
  • hold a permanent visa which allows them to remain in Australia indefinitely, or
  • hold a special category visa and be likely to remain in Australia permanently, or
  • hold a special purpose visa and be likely to remain in Australia permanently, or
  • hold a visa that qualifies them for Special Benefit (It is not necessary for the person to actually receive Special Benefit, merely to be residentially qualified for it).

Please note that a temporary absence for the above purpose begins when a customer leaves Australia, regardless of when the child is born. If an eligible customer returns to Australia within 13 weeks of the child's birth and claims within 26 weeks, the temporary absence provisions do not apply. Please note that all eligibility provisions must be satisfied before payments can be made, so this information should be considered as a guide only. Baby Bonus is payable if your family's estimated combined adjusted taxable income is $75,000 or less in the 6 months following the birth of your child or the child coming into your primary care.

When a woman is married and has a child, the law will automatically asume the husband is the fahter of the child. When the mother is not married, the law cannot make an asumption on who the father is. So the father has to state that he is the fahter and the mother has to agree to this.

Each country has its own specific rules on how to do that and you have to do it according to the law of the country the child was born, as there the birth will be registered.
