NACC: Deputy PM Yongyuth found guilty in Alpine case

BANGKOK, 13 June 2012 (NNT) - The National Anti Corruption Commission (NACC) has ruled that Deputy Prime Minister and Interior Minister Yongyuth Wichaidit is guilty in the case of an illegal purchase of a temple land plot or the so-called Alpine case. The NACC will forward its ruling to the Attorney-General for legal processing.

On 12 June 2012, the NACC held a meeting to consider the Alpine case following its previous decision to press charges against former deputy minister of interior Sanoh Thienthong who was found guilty in the purchase of the 732-Rai land plot of Wat Thammikaram Worawiharn. The land has already been developed into the Alpine golf course.

Back in March 2002, Mr.Yongyuth who was the then acting permanent secretary for Interior ascertained that the land purchase was legal. The Council of the State on 11 April 2002 ruled that Mr.Yongyuth’s action was unlawful since temple properties could not be sold or transferred.

The NACC found that Mr.Yongyuth breached Section 157 of the Criminal Code and would face a severe disciplinary penalty.

This article didn't explain into great detail of why it was illegal and who were involved. The unnamed website has a better article and I'd love to see how this is going to pan out. 1000 baht that it won't go pass the AG.

Looks like a reconciliation case to me, I know it shouldn't be covered because it isn't a political act, but what the heck, he's a politician, so that's close enough.

Now you see why they want to make sure Yingluck stays out of politics (ironic for being a PM)? They got so much crap stained on them that they didn't want to get her hands dirty.

Just in case someone doesn't remember, before 2001 elections Thaksin bragged on national TV about buying that Alpine land for a good price. Later it was discovered that the land wasn't included in the list of his assets and that led to the infamous 2001 trial where Thaksin pleaded he made an "honest mistake" of transferring ownership of this land and lots of other assets and money to his domestic staff. Then judges manipulated votes on two rulings to acquit him and that case was pinpointed as the beginning of Thai recent political struggles by Kaset's Truth and Reconciliation commission. Kaset was one of the founders of Thai Rak Thai.

The land was originally donated to a temple by a dying woman, Sanoh argued that the temple can't afford to maintain it and, being a guy in charge of government agency handling the matter, managed to buy it for himself, then sold it to Thaksin, then went on TV and told everyone about it.

What they don't say here that "fomer deputy minister of interior Sanoh Thienthong who was found guilty" actually got off on a technicality because the NACC had filed the case too late, i.e after the statute of limitations had run out. So having been embarrased once I presume they've got Yongyuth nicked under a law that doesn't have a statute of limitation or will the OAG rule this one out of time too?

The Supreme Court on Friday cited statutory limitations to dismiss a case arising from the so-called “Alpine Scandal” against a former interior minister on charges of allegedly abusing his authority to purchase two plots of land.

A nine-member committee of the National Anti-Corruption Commission made a unanimous decision to try Snoh Thienthong, also Pracharaj Party leader, in February.

The commission sued Snoh for alleged corruption related to the Alpine land scam when he was the interior minister in 1990.

The NACC report was forwarded to the Office of the Attorney-general for trial preparation.

There's a 20 year window and Yongyudth's case was filed in 2002. So they have 10 more years to sort his out.

It's just all part of the Yungyucky / Yongyucky families .... = Deputy Prime Minister PM Yongyuth (Yongyucky ) + Yingluck ( Yingyucky PM who stays out of politics even though she is PM (ironic for being a PM)? ... well this is how it goes just soooo bloody yucky all the way .... How can this yucky thing be stopped so Thailand can get back to normal ..? Beats me ..and how can any other countries in this world going through the same bloody thing get back to normalcy ...?? What a funny post, Annabel, I assume you have inserted the bit in capitals. The ads are from Google, not Thai Visa, and they tend to pop up in relation to any searches you have done on line, as your key words are remembered and generate the appropriate ad. A bespoke service so to speak! So, are you fat, been looking at diets, searching about food? The ads are tailored to you biggrin.png. There is an ad on on firefox that gets rid of the google ads.

NACC finds Yongyuth guilty in 2002 Alpine land scandal

BANGKOK: -- The National Anti-Corruption Commission (NACC) has found Deputy Prime Minister and Interior Minister Yongyuth Wichaidit guilty of malfeasance in a case relating to the Alpine Golf Course scandal.

However, NACC member Klanarong Chantik said the indictment would have no effect on Yongyuth's current position as the crime was committed while he was a deputy permanent-secretary and acting permanent secretary of interior.

Klanarong conceded the NACC had ruled on the case on Tuesday but did not hold a press conference as Vicha Mahakhun, the NACC member in charge of the case, was leaving on a trip abroad yesterday.

The NACC must make a resolution to forward the case to the attorney-general before a criminal case can proceed.

Yongyuth's part in the scandal of the Alpine Golf Club's land took place in 2002 when he approved the sale and ownership of the land to Alpine - although the land was monastic land and could not be sold or transferred.

NACC member Vichai Vivitsevi said the NACC was expected to send the case to the state attorney for criminal proceeding within a few weeks. However, he was not sure that Yongyuth's disciplinary penalties for the breach of malfeasance law could be imposed retroactively.

Yongyuth, who joined Prime Minister Yingluck Shinawatra during her flood inspection trip, was in a serious mood yesterday morning. He refused to answer the media's questions, saying he had not acknowledged the NACC's decision officially.

Democrat MP Suthep Thaugsuban said the Democrats might take the case as part of a censure debate in the upcoming parliamentary session.

The plots of land at issue in Pathum Thani - 927 rai in total - were donated by Nuam Chamnanchartsakda to Thammikaram Temple in her will in 1969.

In 1990, Nuam's heritage managers were forced out and replaced by the Mahamakut Buddhist University Foundation. The land was sold to Alpine Real Estate and Alpine Golf and Sports Club.

The companies, owned by family and friends of veteran politician Snoh Thienthong who was deputy interior minister in charge of the Land Department at that time, developed the real estate and golf course. The assets were later sold to former premier Thaksin Shinawatra with the help of former Thai Rak Thai executive Pongsak Ruktapongpisal.

However, after legal fighting among stakeholders, the Council of State in 2001 announced the land was actually monastic land and could not be sold or transferred. The legal transfer had to be revoked.

The asset holders in Alpine then appealed to Yongyuth.

Snoh's case was dismissed by the court in 2010 under the statute of limitations.

No doubt he will get away with it. Inferior Minister Yongyuth Wichaidit has been "made" by the Family. If the charge was more serious they could just draft a Bill for him. I think they should have a 'Running Man' deathmatch for people like him. Hard time or prime time. Start running.

Poor Yongyuth he is a long standing member of the Thaksin faction one less Thaksinite in governement. Can a convicted criminal still be in government?

You're right it is a Google add ... I didn't realize that they can just insert their adds randomly without permission ....?? Am I fat ...?? At 44 Kgs ...?? What do you think...? :-))))

While not commenting on the fairness or otherwise of the law involved, if land can only be transferred to and never from the church, inevitably all of the private land in Thailand will be church property?

His defense is that he was elected by the people and so is untouchable.

Also he is in a different government post now so cannot be punished for the actions done in the previous position.

This is also the tactic used to protect governments from censure debates - just reshuffle the cabinet, opposition can only argue against sitting ministers, not the ones that have been moved to new positions.

Yes, that's how it reads. Apparently you can only be punished prospectively for things you may do in the future.

Correct me if I am wrong but didn't the PM &/or the family who's name begins with S have a controlling interest in SC Asset, a company involved with Alpine?
