Seperated For 1 1/2 Years - Time For Divorce

Hi

I've been married to my wife for 8 years, we have a 7 year old son together

who lives with me. We have been seperated for 1 1/2 years.

I have now been living in the north of thailand for 1 year and she is

living in the south. I left her because she was in and out of trouble

with the police.

I have just found out she is now in jail for 1 year. We had land and property,

but she sold off the land, and I believe the property will soon be taken

back by the bank, which she is back in court again for this week.

I've waited along time for her to sort her problems out, but have been lied

to, and fobbed off, for long enough.

I called asking her to divorce. I said she can go to her amphur office and I can go

to mine here, and it can be done easy. But she would not return my calls.

So now she is in jail on drug charges.

What are my options? I want to divorce asap. I have no money to pay her for a quick divorce

as she has had it all!

Is is best to use a lawyer from here or to go through a local lawyer from down there? What would be the cost?

Does this now have to go through the courts and a judge will decide?

If she refuses divorce, what are my options?

Sorry for the questions but I really need some closure on this.

Since she you can't get a divorce at the amphur, you will have to get a lawyer and file for divorce at court. Not sure which court, it will either be the court for the area where you are registered as living or the court where she is registered in a household registration.

The cost will largly depent on your lawyers fee and on if your wife is willing to cooperate with the divorce or not. If she stalls the procedings, it will cost you more.

Try contact her family to convince her to grant you an amphur divorce, if possible. You can't persuade her with money, but you can persuade her with the reason you will seek divorce. Her family will lose face if you file for divorce because she is in jail.
