Folks. I am sure that someone here will have some advice. I entered in June on a single entry non O Visa issued from the Thai Embassy Singapore. This with the idea of getting the Company sorted to get a WP.

This has been so slow it looks like this Visa will expire before I can get this underway.

Would I need to get an extension here, or do I have to exit, get another non O and start again?

Any feedback most appreciated.

On what basis was the "O" Visa issued? If marriage, a 60 day extension may be possible, or a one year if you meet the financial qualifications.

thanks for your quick response Beech guy. Yes issued on the basis of marriage. For the 60 day, that can be done here?

It's just that this one expires at the same time I need to travel, late August, and I don't want it to get untidy.

You might as well get a new visa for return if you have to travel anyhow. Is there a reason you have not extended your stay one year for marriage? Setting up a company is not going to allow extension any time soon (must have a years tax records). If unable to extend you might want to consider a multi entry visa (KL will issue for normal paperwork and 100k in bank account - Savannakhet without financial proof).

I should have explained that I am not starting a new company. My employer is re-birthing, an already in place company that is registered, paying its taxes, but not trading for some Years.

There are some hold ups with that, changes of directors etc.

I probably will come back via Singapore and just get another Non O, and hope that they have things in place.

Seems I am in a very similar situation WP-wise (hold up due to change of directors etc.) just that I need a non B. Have a letter from Labour though! Posted a few posts below...

You should still get the 60 day extension to visit your wife. Your work permit can be issued on that extension since it is an extension of a non immigrant visa entry.

I don't know too much about the question, but I hold a non-O visa too, and in my case, I don't know why.....but I don't need go out the country each 90 days, as you are talking about, I went with my wife and a lawyer (provided by her company) to the One stop service center for visa and work permit, I got a stamp, that let me stay for one year.....I just have to go to the bureau each 90 days to notify I will stay longer...and then 90 days +.

I thought every Non-O holders would have the same deal....

It appears you had a non immigrant O visa (which only allows a stay of 90 days) issued on the basis of your wife having a one year extension of stay for work; and have extended that stay on the basis of being a dependent of your working wife. Every 90 days that you stay in Thailand you have to report address as anyone else staying longer than 90 days must do.

You should still get the 60 day extension to visit your wife. Your work permit can be issued on that extension since it is an extension of a non immigrant visa entry.

Please note that some Labour Departments will not issue Work Permits against the 60 day 'Visiting Wife' Extension (Police Order 777/2551 Section 2.24) as they maintain that the original Non 'B'/ Non 'O' status is lost with such a 60 day extension.

Thank you for your advice all.

The intent was to come in on the single entry Non O, then the company stuff would be sorted, employment contract/ WP, and extend. As the Company side of things has dragged this wont happen. I have about 18 days to run.

Of course, i havent worked yet.

I will check it out with Immigration, and if no joy, i think i can get another Non O in Singapore, and start the process again.

If I am wide off the mark, I am sure someone will pull me up heresmile.png

To save a trip out for a new visa it might be worth the time and expense to get the 60 day extension and then try to get the work permit with the extension. You could then get a re-entry permit (1000 baht) for your trip out of the country that would allow you re-enter the country up to your permit to stay date of the extension.

Suggest you talk to your local Labour Dept before you try the above as some will point blank refuse to issue a WP against this particular 60 Day Extension Category.

I think the issue is about the same as some offices not issuing WP's with a non-o visa or even an extension based upon marriage. They are reading the rules differently or making up there own at some offices.

Even if issuance of WP was not possible he could apply and then make one trip out of the country to get another visa which could be a non-b with the WP3.
