Briton's Killers Appeal Against Death Sentences

Two Thai fishermen sentenced to death for the rape and murder of the British backpacker Katherine Horton are appealing for the sentences to be reduced.

Bualoi Posit, 23, and 24-year-old Wichai Somkhaoyai face lethal injection for killing Ms Horton, who disappeared while holidaying in Koh Samui with her friend Ruth Adams on New Year's Day. Her body was later found floating in the sea.

Bualoi and Wichai told a Thai court they should be given credit for their co-operation with police and their guilty pleas despite a lack of witnesses.

Their lawyer, Phrompachara Namuang, said the appeal - automatic under Thai law - had been submitted on the grounds that the death penalty was "too harsh".

DNA tests had linked the two to the attack but there were no witnesses to the crime, he said.

"The defendants were fully co-operative [with authorities], which greatly helped to expedite the judicial process," he added. "They should be given leniency for this."

A Royal Thai police spokesman said the judge had also been asked to consider Ms Horton's family's views on the death penalty.

Family members have insisted they have never publicly expressed an opinion on the sentences, and said they did not want to be involved in the criminal and political processes of another country.

Bualoi and Wichai were found guilty on January 18 of murdering Ms Horton, a 21-year-old student. She disappeared as she walked along a beach while speaking to her mother in Cardiff on her mobile phone.

Bualoi told police he had grabbed Ms Horton's arms, while Wichai admitted repeatedly hitting her on the head with a stick before the pair raped her and threw her body into the sea. The case was fast-tracked through the court system, and eight prosecution witnesses - but no defence witnesses - were heard.

Thai courts usually reduce such sentences to life imprisonment or less in cases in which defendants plead guilty.

However, the Thai prime minister, Thaksin Shinawatra, made an unusual public appeal for the killers to receive the "hardest punishment" possible, saying the killing had hurt the country's image and could damage its tourism industry.

The appeal, which usually takes around a year, could take less than a month to complete, Thai police said.

These 2 fishermen had been drinking, they had been drinking a lot so after swimming to the shore which would have been enegry sapping they still managed to attack and have sex.

I don't get it because i can always get it up when i am loaded but most guys cant and not even I can finish (u know what i mean - come) if I have been drinking.

I doubt that is possible and even if it is, they have crapped on their own doorstep and damaged the livlihood (tourism) of all their locals, and if that was the case then the mafia would have shot them before they had even been arrested, surely.

Was the death penalty 'too harsh' or was it not harsh enough. Personally i can't quite decide which is worse, a painless death by lethal injection, or living out the rest of your days in the miserable conditions of a Thai prison. If their appeal is successful and they are allowed to live, then it has to be with the proviso that they are never eligible for release. They may end up wishing they'd taken the death sentence.

You are great sbk, okay, the fishermen were kinda local but not from Samui but that isn't the thing they were thai. About the DNA test. I am not saying here that I believe the conspiricy i am putting on you but its a possiblilty. I am willing to hear all possibilities.

If the fishermen did not do it and a couple of undesirable falangs did the crime then the only way we will get a true DNA match is when one of them rapes again in their own country.

My other point is that the newspapers and thye tv TELL us what to believe, we dont choose to believe it we just choose toassume it is true just as people choose to assume that i am not serious or whatever, it is the easy option. People want easy and people want fast and most people, want justice but not the main man Mr T, he only cares about status.

What concerns me more than some of the observations in this thread is the interference by the leading politician of Thailand in a supposedly independent judicial process BEFORE the judge came to his judgement.

Prime Minister Thaksin should reserve his comments until after the judgement. As it is, if these two Cambodian (I understand) fisherman receive a lethal injection, then it will be a tainted judgement by the Thai justice system because we will never know exactly what effect the Prime Minister had on the judicial process, in spite of the trial judge's publicised statements.

As others have said, death would seem the 'easy' way out compared to the lifetime of sadness experienced by Miss Horton's parents, family and friends. Fancy outliving your children! It should never happen!

They didnt swim as such but kick paddled their way in using empty containers for flotation...and they werent breaking any records either...not a lot of energy wasted there.

The investigation turned to these guys after they had boasted about the crime. Not even the poorest or dumbest of fishermen would believe that a year in jail would be an option after a rape and murder... Even the mafia would find it hard to kill someone who is miles out to sea....remember the cops went out to the boat to get these guys after it had gone back to sea.

Did you mean the "Hey Mum, look at me, I am on TV" smiles....a lot of Thais smiles as soon as you point a camera at them....it seems to be a natural reaction.

Execution is not an assured thing here....they pleaded guilty which usually means that it will be reduced to life in prison...If that doesnt happen then it could well be suspected that there has been political influence brought upon the case.

Here in Holland (the Netherlands), we've got fair notary's and good laboratory's. Arrange a notary from Holland and a notary from Thailand. Let them both take DNA from these blokes. Let them take the DNA to Holland for research and let the results deposite to the court by these notary's ...
