Hi

I am hoping to get some advice on where I should start. I am a Thai National and married an Italian in Italy around 3 years ago. I was living in Italy and the marriage dissolved rapidly as he began to drink heavily. I moved out after he admitted himself to hospital for treatment. I moved back to Thailand and have had no contact with him at all for 2 years. He has continued to support me with the sum of 5000 baht per month since the separation in January. This has not been continuous and there has been periods of 2 and 3 months with out anything being transferred. Although we have had no personal contact, He has a friend who has organised the western union transfers who used to contact me and tell me when to expect money via transfer or through a bank account transfer.

I no longer have these telephone numbers and am finding it hard to contact him at all. I wish to get a divorce from him and dont know where to start. I have been told that divorce in Italy is very hard and can take many years. I am hoping this can be done as fast as possible.

Can anybody give me some advice where I should start.

You should be able to file for divorce in Thailand, if now living in Thailand. Btu that means two hurdles will need to be taken:

1. The foreign marriage must first be registered with the Thai government. That means the wedding certificate confirmed (legalised) by the Italian embassy, translated into Thai and than legalised by the Thai Foreign Ministry, consular department. When that is done the marriage can be registered at any amphur.

2. Next you can file for divorce, but it makes a big difference if you both agree to a divorce or not. If not, you can only divorce on the grounds specified by law. Abandonment is a good reason, but I believe can only be filed by the person being abandond.

It is much, much easier if you both agree and he is willing to travel to Thailand. Then it is just a matter of signing the divorce register at the amphur and you are divorced in about 30 minutes.

So if there is anyway you can contact him (perhaps do an internet search on his name or his friends name) and can convince him to come to Thailand and get a divorce, it is quick and painless.

Under Thai law there is no alimoney, under Italian law it will be difficult to get a divorce but you might be entitled to an alimoney.
