Hi all,

I have been working for a 100% Thai company for the past 5 years. Because I frequently travel abroad, until recently I applied for, and received 1-year non-B multiple entry visas from my European home country. The last time however, they woud not issue me a multiple, only a 90-day single entry. The reason given was that I have a workpermit, and can apply for an extension in Thailand. My salary is high enough to go this route, so I wasn't really worried about this new policy.

Anyway, I am now going through the process of applying for an extension, and the immigration just contacted my boss, with the notion that the Thai staff's salary is not high enough. One staff is on a salary of 30,000 a month, the others at 5,000 a month. Immigration claims it needs to be a minimum of 7,200 a month for all. Nowhere can I find any reference to this requirement. The company is in Surat Thani, which has a minimum wage of THB 240 a day, which equals to around THB 5,000 a month, based on a 5-day workweek. Is this a mistake from immigration? Are they thinking the 240 Baht has to be multiplied by 30 days, to get to the minmum monthly salary?The boss doesn't really want to increase staff's wages, until the 1st of January when it has to be done by law...

Get yourself another set of company papers and go to another consulate/embassy.

But check, that your wp is longer valid, than 8 month.

If the stamps in your passport showing, that you are traveling that much, there shouldn't be a big problem, to get the multiple Non B.

Interesting one - Immigration are rarely interested in the letter of the Labour Law and vice-versa for Labour re Immigration matters - they both belong to separate Government Ministries and there is normally little cross over of each's respective territories.

That notwithstanding if they stipulate a mimimum wage for Thai Employees of 7,200 in your area then what can your employer do?

Despite the fact there is nothing in the Police Order to specify such an thing for Thai employees, there is a clause stating the employing company should have a 'sound financial position' - this could be read as paying more than the minimum local wage.

Other than Bank, Goverment Employees and a few fortunate others, Thais normally work at least 6 days week. so the best that could be argued for is (52x6)/12= an average of 26 days pcm working.

However if immigration insist that locally, 240/day is for 30 days then 7,200 pcm it is.

As posted above, as an alternative, KL will issue Multiple Entry Non Immigrant Type 'B' Visas for WPs with >8 month validity along with all the other required Company Papers (see link below).

Thank you for your replies. Salary of the Thai staff has been raised to THB 7,200. Hopefully immigration is satisfied with this...
