Please forgive me if this question has been asked before but I am totaly confused about what I need to do next, here goes.

My Thai wife came here on December the 4th 2010, the proud and happy holder of a 27 month settlement /spouse visa.

We now want to apply for her ILR but all of the information on UKBA web site is contradictory or vague.

Last year she was studying to take and pass the old Life in the UK test, then as we know the test was changed for the better I might add.

She is now learning the new silubus but I fear she will not be ready before we have to apply.

Also the ILR application form states that we have to have a combined income of £18000.

Can somebody please clarify what we need. IE Life in the UK pass document,english language level 1,and the £18000 per anum.

Or should we apply for FLR until she passes her exam? and what will we need for that?

PS the good advice I got from this site helped me secure her original visa I know you will do the same again.

As your wife applied for her original settlement visa before 9th July 2012 she comes under the old rules for her ILR application.

This means no minimum income is required, but you must be able to show that you can support and accommodate your selves without recourse to public funds.

The knowledge of life and language (KOL) requirement changes for all ILR applicants in October 2013.

However, if she is applying for ILR before this then she can still meet the requirement by either passing the LitUK test or by completing an ESOL with citizenship course from an approved provider.

Time is running out for her to make an ILR application. If she has not satisfied KOL by the time her current leave to Remain expires then she will need to apply for FLR.
