(This is regarding them as PoWs, which you seem to persist on regardless of what the US gov classifies them as, or any info posted here) You're the one with the comprehension problem! POWs are not entitled to a judicial investigation just because they are POWs. Only POWs who are being charged with a war crime are entitled to this sort of due process. Any other POW is just that, a prisoner. No entitlements. No nothing beyond the basics of food, water, freedom to pray, etc. Why you have no room in your feeble mind for such a simple concept is beyond me!

Other detainee(s) who are innocent or not worthy of a trial I'd give back to the Afghanistan/Iraq authorities since those countries are the ones that were ultimately underminded by the detainee(s) behaviour.
