Thai team to fight temple dispute with a 'twist' from Cambodia

BANGKOK, March 28 – The legal team defending the Thai position in the Phra Viharn (Preah Vihear) dispute next month will insist on the world court’s impotence to give a ruling on the land dispute as proposed by Cambodia.

Veerachai Palasai, Thai ambassador to The Hague, said the Cambodian complaint about a plot of land adjacent to the Phra Viharn (Preah Vihear) temple was a new issue and the International Court of Justice (ICJ) is not authorised to take it into consideration.

Cambodia told the ICJ that it wanted the court to reinterpret its 1962 decision concerning the 4.6 sq km of scrubland near the temple to determine if the land belongs to Cambodia or Thailand.

Mr Veerachai said Cambodia had submitted the issue to the ICJ in 1959 only to have the petition rejected, and that the Thai legal team will stress that it is a similar issue and that the court is not empowered to reconsider it.

Cambodia will give an oral statement before the ICJ on April 14 to be followed by Thailand on the next day. Cambodia is scheduled to make its closing statement on April 17 while Thailand will follow.

Mr Veerachai said the Thai Foreign Ministry will set up a media centre on April 14-19 during which authorised interpreters will be available to give word-for-word translation of the court sessions, to be broadcast via the Internet.

He gave reassurances that the Thai legal team will do its best in defending the case. (MCOT online news)

Phra Viharn hearings to air live in Thailand

BANGKOK, 28 March 2013 (NNT) - Education Minister Phongthep Thepkanjana, who is leading Thailand's legal team in the Phra Viharn temple case against Cambodia at the International Court of Justice (ICJ), has said that the government will air the hearings live on television and radio.

According to Mr Phongthep, the live broadcast would cover parts of the hearing session, with Thai translations voiced over the ICJ medium - French. However, he said it has not been decided yet which parts of the hearings will be covered on live broadcast, and which channel will be asked to air it.

As the head of the Thai legal team, Mr Phongthep stated that the team would fight the case with "utmost determination and care".

The legal case between Thailand and Cambodia is a result of Cambodia's request in 2011 for the ICJ to order Thai troops out of the areas around THE Phra Viharn temple.

Between 2008 and 2011, the Thai government, pressured by nationalist groups, sent in troops to areas near the Phra Viharn temple and expelled Cambodian settlements in the areas. Resulting clashes between Cambodian and Thai troops saw injuries and deaths, including civilian death, on both sides.

That's why the world has an 'International' court of justice. To administer, amend and uphold the law. To thumb ones' nose at it, is contempt of court. But as the Kingdom does not recognise any jurisdiction outside its borders (unless it suits them) this is again, much to do about nothing and will go nowhere.

That's why the world has an 'International' court of justice. To administer, amend and uphold the law. To thumb ones' nose at it, is contempt of court. But as the Kingdom does not recognise any jurisdiction outside its borders (unless it suits them) this is again, much to do about nothing and will go nowhere.

What the international court is saying is just going ear in, other ear out from the Thai Justice Ministries, in reality they want the temple at all cost, no matter what it takes, so they keep stubbornly pushing like a warthog possessed...

That's called Thai government justice ministers backstabbing Cambodians of their temple right, that has been granted TO Cambodians a few years ago already.

It's like bullied ganging up on children when the big daddy is not around, and the international Court of justice people can't be in between Thailand and Cambodia all the time, but this is when the backstabbing Thai Justice people will take advantage again to backstab in the temple dispute,.... which is shameful for the Justice ministries of Thailand...

Most courts, and I am pretty sure that includes this court, have no real power to enforce their rulings. It takes a certain level of respect for the Court for the rulings to be obeyed.

I have it correct.

The Siamese tried to take advantage of France's weakness during WWII to mount an attack to take those areas by force, and were rightly denied their claim over them at the end of the war. The Victory Monument in Bangkok commissioned by the fascist dictator Phibun commemorates this short-lived victory.

The ceding of other lands to the French were of course made to guarantee Siam's independence from France's territorial and colonial ambitions over the entire country. The Siamese were lucky that France did not exercise those ambitions, and have, in part, the British to thank for that.

Perhaps it would be easier all round if the two head honchos, blood brothers Thaksin and Hun Sen decided what happens in their countries between themselves.... a bit like they do already.... maybe over a game of golf.

They could even televise it live. The Preah Vihear Matchplay sounds good and it would certainly be more interesting than watching Muay Thai or soppy soaps.

Presumably the only guys who do this type of work are the football commentators attempting to parrot the live feed on the EPL. Can't wait for the "
ohhhhhohs".

Of course the Thai TV could really get hold of it, and add a few :"boiiiiiings, and whistles" to keep the people interested. This in reality will be like watching paint dry, until the commentators get hold of it, and whip up a frenzy depending on the colour of their shirts.

The three provinces that were given back to Cambodia in 1907 have always been inhabited by Khmers. The Siamese were on foreign territory and didn't even have their own police force there.

The three provinces that were given back to Cambodia in 1907 have always been inhabited by Khmers. The Siamese were on foreign territory and didn't even have their own police force there.

Going back farther in history it was all Khemers occupied the land and even to this day there language can be found in use there. Is Thai spoken on the Cambodian side of the border?

People miss the whole point by dwelling in the past. As can be seen they only go to a point that proves there pet theory beyond that they would be wrong.

We are in the year 2013 fighting over a problem that was not in existence until some people wearing yellow shirts decided to make it one. The result was death and destruction where there had previously been none in the last 50 years just peace.

Today we have two countries forced into a political situation neither wanted and neither one is willing to work together with the other one to create a mutually agreeable Historic location that would not only stop the violence but be of economic value to the both of them as they present the whole package as a World Historical Treasure.sad.png

Today we have two countries forced into a political situation neither wanted and neither one is willing to work together with the other one to create a mutually agreeable Historic location that would not only stop the violence but be of economic value to the both of them as they present the whole package as a World Historical Treasure.sad.png

I don't believe that people wearing yellow shirts had anything to do with the Thais taking over the temple in 1959 when the problem came in to existence.

Classic wag the dog..... Need to distract from the 2 trillion baht spending bill. Bet we see this issue ramp up in the very near future...

I thought it was the other way around--the 2 trillion was a diversion from the Pra Viharn situation.
