hi peeps

i am english, and in october 2011 i tried with my thai wifes help to bring her daughter to come live with us here in england, we got refused. and im sure many here know its not a cheap thing to do, so now again this year in september we are going to try again. the thing is though now i have heard from a few sources that a few laws have changed yet again (what a surprise) and now you have to be earning at least £18000- a year in order to be eligable to bring a child under 18 to england on a settlement visa. if anyone could enlighten me on any changes that i should know about or the best way of going about obtaining a child settlement visa, i will be very greatful.

What were the grounds for the refusal, you need to ensure that these have been addressed first.

As for the income, the new rules are that to bring a spouse to the UK you have to demonstrate an income of £18600, or the savings equivalent, this figure rises for each dependent child.

As your wife is already in the UK this rule may not apply, I'm not sure if there is a figure for the child though.

As I say, in the first instance you need to address the reasons for the original refusal.

As theoldgit says, it will depend a lot on why the child was refused last time. If you can post the refusal notice ( deleting any personal details ) we can give you more advice. If it was because your wife couldn't show that she had "sole responsibility" for the child, then hopefully you will have got together some evidence of that since the refusal.

If your wife has Indefinite Leave to Remain in the UK, or got her settlement visa before the 9th July 2012, then you have to show that you can support and accommodate the child. There is no exact financial threshold to be met.

had the same problem ,you should have appealed ,we got there after the court case took one year ,but best get good agent in thailand ,pay the money get what you wont

I'll check when I get home for the link to the UK immigration visa page and post it for you as I looked this up recently.

The minimum gross salary for partner and 1 child, if I remember correctly, is around £22k. It then goes up for each subsequent child.

If no one responds beforehand I'll post the link later.

The current sponsor's income requirement is £18,600 p.a., for a spouse/partner plus 1 child it is £22,400 p.a. and it increases by £2,400 p.a. for each additional child.

But

As TVE says above, if your wife is already settled in the UK then there is no set minimum figure required. Instead you need to show that you can support and accommodate the child without recourse to public funds.

Upon reading your plight I immediately wondered about your stepdaughter; has she been legally adopted by you? If so, then would she not carry your surname? If all this is so then would you not be able to apply for a UK passport for her?

What do I know - I am only attempting to be logical.

Upon reading your plight I immediately wondered about your stepdaughter; has she been legally adopted by you? If so, then would she not carry your surname? If all this is so then would you not be able to apply for a UK passport for her?

What do I know - I am only attempting to be logical.

Inter country adoption is a by no means straightforward matter; even when the person attempting adoption is married to one of the child's natural parents.

Even if successful; adoption by a British citizen does not automaticaly confer British citizenship upon the child, so she would probably still need a visa to live in the UK.

go to citizens advice in your area they have helped a friend of mine he had to go to court and have a judge rule in his favour it took him about 1 year to get it all sorted. the judge said the children should be with their mother. Alas the children were not stepchildren. But try anyway whats the halm in asking.. good luck..

It's also a long drawn out procedure involving the UK social services as well as their counterparts etc in Thailand. I contemplated it some yours ago with my stepson but gave up. I'd stick to the more straightforward approach of getting the mother to make the application.
