I made a huge mistake thinking that because my annual retirement visa was due at the same time as my 90 day report that by renewing my retirement visa I was covering the 90 day reporting requirement. Not so! The officer said the two are different and I was on 90 days of overstay! The cost is 5,000 baht and 500 baht a day for my misunderstanding, However due to the circumstances I was allowed to pay a 2,000 baht penalty and sent on my way with a fresh 90 day stamp.

It's my understanding that the fine for not doing the 90 day report is 200 baht/day, but to a max of 5000 baht, but in reality most people are simply charged 2000 baht unless they flagrantly disregard the 90 day reporting (like never doing it) or make a scene in the Immigration office.

Being late on a 90 day report isn't the same as being on "overstay". The fine for overstaying your visa permission to remain is 500 baht/day up to a max of 20,000 baht with jail time a possibility for flagrant overstayers. Many threads on this subject.

What the OP did is a common mistake, that smart people make only once. My husband did it, until I took over visa management for both of us. Actually, by neglecting to do his 90 day report until I asked because I was doing mine, he did himself a bit of a favor. We had been "out of sync" with our 90 day reports due at widely different dates. Since he went and paid the fine and did his 90 day report at the same time I did my on-time 90 day report, we now have 90 day report due dates that are identical and it's easy for me to do both reports at the same time.

Official fine called out in immigration act is max of 5000 baht plus 200 baht a day for not reporting.

Immigration act:

Section 76 :

Any alien, alien, who fails to comply with the provisions of Section 37(2),(3),(4)or(5) shall be

punished with a fine not exceeding 5,000 Baht and with and additional fine not exceeding 200 Baht for

each day which passes until the law is complied with.

Above is the official wording and it has never been further defined - official policy is only listed as 2k for reporting late or 4k for arrest and found late. Expect the 200 bath per day would be if fined it would increase 200 baht per day until paid.

I was thinking the same way. Now I'm a bit afraid that I could have problems. I renewed my retirement visa 90 days ago. But I didn't make the 90 days report because I was thinking that it should be absolete due to the visa extension. Tomorrow I'm planning to leave Thailand by plane for a short holiday. I hope the immigration at the airport will not make problems.

Yes, I also think that they don't check the 90 days report at the airport. When I'm back in Thailand I will report after 90 days and I think that they also will not notice because I have a new arrivel date from which the 90 days are counting.

I've made that same mistake and paid the same 2000 baht fine in 2007. I like the quote and agree with the quote in post #5: "What the OP did is a common mistake, that smart people make only once." I can remember the Immigration staff woman saying "90 day and 1 year Not same same". She is absolutely right.

Just made the same mistake myself and am 2000bt the lighter, but not feeling bad about myself on this one, for some reason I also thought the 90 day report ceased with the end of an old visa and began again with the commencement of my retirement visa.

I wouldn't bank on your local immigration office not noticing if, indeed, a 90-day report was overdue wheh you exited Thailand. They can easily check this on their computer AFAIK.
