A Couple More Questions

Whilst I am asking questions on Thai property…………….

I have a fair grasp on the Thai ownership laws for Foreigners, but in regard to Condos whilst a foreign individual can own a Condo (subject to the restriction of total foreign ownership in the Block), can instead a Foreign Company own the Condo?

Although not applicable to me, I gather that the land ownership by foreigners “problem” can be “cured” by using a Thai company owned by a Majority of Thai Shareholders who effectively own the Thai company for the Foreigner, is this 100% legal and bullet proof or is it the case that this arrangement is just accepted practice, but is still theoretically attackable by the government?

Also can the Thai Company effectively be held for a Foreign Company instead of a Foreign Individual?

A foreigner can own a condo. Why would you go to the extra expense to form a company to own a condo? With a single exception, that doesn't make any sense at all. The single exception addresses the law that a condo building must have 51% ownership. If the building ha too many non-Thais, you can form a company to buy a condo. And you're right, this question is asked very frequently because no one uses the search function.

My question was specific to a FOREIGN Company owning a Condo ("Foreign" in this context being NOT a Thai Company). And the Foreign Company would not be an extra expense. The rationale is immaterial here, and is in any case not specific to the Thai end of the transaction.

The question regarding Land ownership was seperate from Condo ownership (but thanks for the info anyway, using a Thai Company for a Condo was not something that had yet occurred to me). I was however actually just after to find out whether their were any dissenting views currently around regarding the Thai Company ownership route being 100% bombproof in regard to being a vehicle for a Farang owning LAND in Thailand - or whether in certain circumstances it could be (or has been?!) "looked through" by the Thai Courts or Thai Officials.

What can I say :o

Cheers anyway.
