Changing visa category "O" to "B"

Hi friends,

I am recruiting an employee who is a myanmar nationality. She come to Thailand with her husband and obtained an Non-immigration "O" category VISA as a spouse.

May I have the idea of changing VISA category from "O" to "B". One of my outsource VISA advisor told me she have to leave Thailand and do the "B" Type VISA from her country. If so, what document is needed from the company side to do so.

Anybody experience on that. please kindly advise.

The work will be Assistant manager to do international sales and marketing

Is her Husband Thai or a foreigner himself?

If Thai, she should be able to get a work permit without the need of a new visa. If she is the dependent of a foreign husband she will be required to leave the county and obtain a non-B visa.

Documents needed are generally:

1. passport + copies

2. passphotos

3. application form

4. letter from future employer stating that applicant will work for them

5. list of shareholders

6. copy ID/passport of major shareholder

7. company registration

8. fees

A non-immigrant B - single entry - 90 day visum will be issued.

Within 7 days from return to Thailand the application for the WP should be started.

That's info I've got from the Thai consulate I usually go to.

Visa paperwork can vary depending on which Consulate you apply at; requirements tend to be tighter in the SE Asia countries adjoining Thailand.

The only problem might be getting the work permit because some offices will not issue work permit on a visa obtained as a dependent.

If the work permit is issued then go to immigration and get an extension based upon working verses as dependent or she could stay on the dependent extension and work.

I am a British farang with a Thai wife. I have an "O" visa and a work permit. Does not seem to be a problem. Immigration did ask my wife why she bothered to marry a farang earning less than her.... To which she replied "LOVE"!

You are not here as a dependent. You are here on basis of wife being Thai. We have asked OP if husband is Thai but there has not been any answer.

Her husband is also Myanmar, who have a contract work in Thailand. He already obtained Type B and work permit.

In that case she is here as a dependent of husband and do not believe most labor offices will issue a work permit on that type of entry so a non immigrant B visa application may be required. You should be able to ask labor office.
