Non B cancellation dilemma.

I have a dilemma in regard to a non b visa cancellation which has been made more complicated by some incorrect advice.

I have a non b (extension) which expires at the end of the year, but I ceased work for my employer three months ago.

I was initially told I had no problems until my next 90 day report, which is due and my plan was to fly out of the country and fly back in on the same day and then move on to an ed visa as I am returing to Thai school. I no longer require a non b and work permit.

I have now come to understand that this is not possible on a visa extension and that I should have cancelled the visa at immigration. The problem is that I am unable to get any communication out of ym previous employer, and don't have any idea what action they may or may have not taken.

What is likely to be the case if I fly out tomorrow? Will I be refused exit? Fined? Or thrown in the clink? I expect that I am going to have to pay a 20k fine which is irksome, but not a disaster, I just don't want to have any ongoing issues.

If I go to immigration on Monday I expect that they will ask for a cancellation letter which I can't provide.

Theoretically you are on overstay if I read your post correctly. Just leave, no problem.

Best choice would be to do the trip by air but have the 20k baht handy just in case.

There have reports of immigration at border crossings turning people around because they still had a valid extension. But none for the airport because it would get very complicated for them to do that.

That's my intention. If I get hit for 20k I will write it off as bad luck. If I don't I will buy some duty free.

I am going to fly out an back on the same day, so hopefully I won't get the same official (at the end of a long shift) on the way back in.

No problem flying out and back. There are lots of people doing it on a regular basis.

Have done quite a bit of fly in fly out, but never in this situation. Flights booked. Off to KL this afternoon back tonight.

If your non-B has not been officially cancelled, will it be used by immigration again on your way in? They will stamp your passport exit-by date with your non-B expiry date.

When on an extension of stay and leaving Thailand without a re-entry permit the permission to stay ends on departure.

It can't be used as far as I know. I want to come back in on a 30 day tourist visa.

If you got a multi-entry visa / extension, it would theoretically still be valid when you come back. If you don't have a re-entry permit, then it won't be a problem.

Your permission to stay will automatically be cancelled when you fly out. On return without a visa you get a 30 day visa exempt entry by air.

I don't envisage getting another non b or wp so if this is the extent of the issue, it'll be fine.

You might very well be asked by the immigration officer on exit as to why you do not have a re-entry permit.

He will see an extension based on employment, and no re-entry permit, so might assume this was an oversight on your part.

He will know that if he lets you leave, that on return you will lose your non immigrant status and hence your right to work.

He will assume you are still working, because if not, your extension would (should) have been cancelled (along with possibly a new 7 day extension).

So it would not be hard at all for him to notice something is not quite right.

Then again, fair chance he'll simply stamp you out!

Just in case, check in early enough, so if it causes some delays you won't miss your flight!

I've heard the whole "letter from employer" thing on this forum before but neither immigration nor the ministry of labour had a clue about that. You just have to go to the work permit office and fill in a form. Urban myths spread very easily on thaivisa.

If you have an extension of stay from immigration it needs to be canceled with a visit there where you can obtain a 7 day extension to pack out and they normally ask for a letter from employer. If you are on a 90 day visa entry that would not be required.

Where is your WP now? If you have it in hand, better return it to Labour Department. They may ask you a fine, but it only 1000 thb

Meanwhile your WP and extension will expire anyway.

When I left my previous job (5 years ago), immigration definitely asked me for a letter from the employer and I had to go back to them. No myth, reality.

If rules have changed in the meantime, I am unawares.

Or just go to the work permit office and they'll give you a form that takes about a minute to fill in. A lot simpler than faffing around trying to get your ex-employer to write you a letter.

If you read the form in the link provided you will see that it can be submitted by the employer or the employee; it never requires both signatures, or a letter.

You will also see in the form notes that this process is not time limited.
