I have a 90 day non B visa and a WP. Today I went to Chiang Mai immigration to extend my visa to 1 year. They told me I cant do this because I got my WP and visa from a Thai business, (the business my girlfriend and I run) not an official company. They said they will extend my non B if I marry her. This makes absolutely no sense at all... I already have a non B and a work permit... I just need the extension.

I went to a visa assist place directly after, they suggested I just get a education visa and hope immigration never checks what visa type I have and only look at my work permit if I ever get caught working. Or he suggested I fly to Penang to "Attempt" to get a 1 year multi entry non B visa by showing them my current non B visa and my work permit.

I am thinking maybe I can go to a different city in Thailand to extend my visa? Maybe Udon, Bangkok, Pattaya? Will I have better luck? Should I fly and "attempt" to extend my visa? This all makes ZERO sense at all to me. I just need some solid advice. My visa expires middle of next week. Thanks.

The only choice you have is to go out for a multiple entry visa. Immigration is correct and you would not get it anywhere else.

What do you mean missing paperwork? We have the check list from Chiang Mai immigration, and from the internet, we have everything. The problem is that we dont have a "company" its just a Thai business. Shes telling us we have to get married to do it like this. I got my non B and my work permit through this Thai business, but they are refusing to extend my visa. Its absolutely ridiculous.

If you take look at what Ubonjoe has posted I would think it unlikely the requirements, in your case, can be met.

Getting married would allow you to apply for an extension of stay based upon marriage is what they are saying.

Did you read what it says about it having to be a company in the screen shot I posted. Also there is requirements that taxes have been paid for at least a year which would probably keep you from getting an extension.

Extension of Thai Business Visa
The Thai "B" or Business Visa can be extended to a one year visa in country as follows.
The extension of the visa is normally based on employment and as such there are certain regulations governing the company who is employing you.


These are the regulations for the extension of the "B" Business Visa:
1. The business must be registered in Thailand.
2. The company must be capitalized to at least Baht 2 Million while operating fund must be at least Baht 1 Million.
3. The company must have a ration of at least 4 : 1 - Four Thais for every foreigner.
4. You must earn at least in accordance with the level specified for each nationality by the Labour Department.


Duration of the Extension
- One year at a time.

Documents required for the extension:
1. Application form (T.M. 7 )
2. Passport or document used in lien of passport and its copies .
3. The applicants 4 x 6 cm. photograph .
4. Extension fee Baht 1,900.-
5. The company letters certifying as follows ;
- Nature of business
- Reason or necessity in employing the applicant his / her position, salary and education background.
- Number of Thai and foreign employees.
6. Copies of work permit or receipt of work permit application.
7. Company's annual balance sheets.
8. The juristic persons Annual Income Tax Declaration Form (Form No.50) of the latest year and its receipt of payment.
9. Thai employees Monthly Income Tax Declaration Form (Form No.1 ) of the latest month and its receipt of payment.
10. The applicants Annual Income Tax Declaration Form (Form No.91) of the latest year and its receipt of payment.
11. The official letter that certify the registration of such juristic person.
12. Business Registration or Business License.
13. Value Added Tax Registration and list of share holders.
14. A map that indicate location of the Company.
15. For those who operate export business, the documentary evidence clarifying its export activities is needed.
16. For those who operate tourism business, the documentary evidence clarifying its total number of tourist that brought in by the company is needed.

Welcome to the group of foreigners with WPs who cannot extend their permission to stay within Thailand on the basis if work.

You are only be allowed to apply for an extension at the Thai Immigration Dept based in the area where your Work Permit lists you as working/living.

If you do not work for a public company, limited company or limited partnership, then a National Police Order 777/2551 Case 2.1 Extension (Working in the Kingdom of Thailand) as already posted will not be possible.

You can try Penang who are still issuing One year Multiple EntryNon Immigrant 'B' Visas, but please phone them before you go and check what papers they require - they actually answer the phone (WP remaining validity needs to be more than 7 months).

Forget what you were told about the ED visa, get that and it will invalidate your WP.
