Hi all,

I have a Non-O visa based on my thai son, and I also have a work permit. I now need to extend the Non-O visa based on employment, is it possible? What paperwork do I need for immigration?

My employer told me that I need to fill out application for visa and application for visa change...but this doesn't sound right to me....I'm surely able to keep my Non-O visa and extend it based on my employment, correct?

Please advise!

You can do the extension without obtaining a B visa. Also you cannot change non immigrant visa types at immigration it would require going out of the country to obtain a B visa.

The paper work would be the same as for any extension based upon working under clause 2.1 of police order 777/2551. Your employer should know what is required since they have to supply all the documents..

If you are the legal father by way of marriage or legitimization you could also get an extension based upon having a Thai child. If your income is 40k baht or more a month you could use it to obtain the extension by showing tax payments and your work permit.

Keep doing your visa based on Thai son.

I don't think I need to extend based on employment, but I thought that was the best way to go...could be wrong, but inform me!! :)

I just want the easiest and least amount of paperwork way to do this!

To get an extension of stay based upon working requires more paperwork than any other type of extension.

To get one based upon a Thai child you will need their birth certificate, house book and proof of legal parenthood by way of marriage or legitimization. If divorced you would need the divorce decree showing either joint or full custody of the child. For legitimized parenthood you would need proof that the child is living with you.

You would first get a 30 day under consideration stamp while they approve the extension. Then go back to immigration for the extensions stamp.

The biggest advantage of getting an extension based upon having a child is that if you job ended your extension would still be valid. An extension for working ends on the date your job ends.

if I have everything else but the tabien ban do you think they will approve it?? Our book is far far away from here! Can I use the register from the hotel, which was used to get the work permit?




You have to have at least a copy of the house book child is registered in. It is possible to get a printed out copy of registry from an Amphoe.

You will also need proof of your current address, to show that you are applying at the right immirgation office. The hotel bill should do for that.

So I went to Phuket Immigration office in Phuket Town today and they were unfriendly as usual. They told me that I needed to have a "legitimization of Child" which could only be issued by the family court. Why would I need this if I have his birth certificate, thai and American passport?? Is this correct? They would not even entertain extending my non-o based on thai child without this paper. They instructed me to go to the Amphur to get it, when I went there they told me I needed to go to court to get an order giving the AMphur permission to do it....does this sound right???

If I want to just extend my Non-O based on employment, does anyone have a list of the required docs? My employer does not know what docs are needed....I assume the same type of docs to extend a non-b based on employment??

They are correct.

Your name on the Thai birth certificate means nothing. It is not proof that you are the legal father, only a claim that you are the father made by the person who reported the birth at the amphur and legally nothing more. It doesn't mean you are the legal father.

The amphur is right about you need to go to court, if the child is under 6 or 7 years old. The child and mother must both agree to you being the father and the norm (although the law doesn't mention a specific age) is 7 years old. If the child is younger you need to go through court or marry the mother.

But if you qualify you could apply for an extension of stay based on your work on your current non-O visa. Yes, the exact same documents are needed, as the extension will be for employement. Only your visa entry is non-O and not non-B, but that makess no difference.

As I wrote in my previous post you need the your parenthood legitimized. Your name on the birth certificate is not enough unless you were married to your child's mother.

If child is 7 years old or more the Amphoe can normally do it. If not it has to be done by a court.

The required documents are the same as any extension based upon working. There is nothing special needed because you have a non-o visa.

Edit: See clause 2.1 of Thai Police Order 777/2551 for extension requirements.

You should check with immigration in Phuket to find out what exactly they require.

You clearly have nothing better to do with your life then to pick apart posts on Thai Visa. I said they were unfriendly as usual not because I didn't get what I wanted but because they were UNFRIENDLY AND RUDE to everyone there. That is there way.

I know I've beaten this topic to death, but HR at my work just doesn't get it!! They are claiming that they are going to go to immigration and switch my visa from a Non-O to a Non-B. Can this even be done at immigration? And then they said they needed to leave my passport at immigration "until its ready", but wouldn't I at least get a 30 day under consideration stamp? Considering that I expire on the 21st, the political happenings, I don't think it is smart to leave my passport anywhere....and I've known from the past that they will give a 30 day under consideration, and usually never keep the passports correct?

Well it will be intersting to see how your employer gets on, because you can't change a Non 'B' Visa to a Non 'O' at Immigration.

Suspect your Employer is making the very common mistake of confusing an Extension of Permission to Stay with a Visa - two completely differnet beasts, one allows you enter and one allows you to stay longer.

Here is the list of requirements to Extend Permission to Stay in Phuket based on Employment in the Kingdom of Thailand (which is what I think your HR dept is talking about)..

p.s.immigation does not need to keep your passport for more than a few minutes to enter stamps, sign, etc.

What you mean here is that, a Non-O extension based on employment (teacher) must be min. 40K ฿?
