In most cases you will have to cancel the work permit and extension then go out for a B visa and apply for a new work permit. Unless you can get the new work permit within the 7 days extension you can apply for when you cancel your extension.

Btw urbanjoe, ive read about ur replies on how to cancel work permit, and yeah, ill be given 7 days of stay to go out of the country, right? Apply for tourist visa again?..

Is it possible that on the same day, i cancel my wp on both labour dept and immigration (90days stay) then apply for non-b visa, if my non-b will be granted, then ill be given 3 months to process my work permit, right? If yes, am i still obliged to go out of country within 7 days?.

Coz ive found this steps while reading threads,

You will not be able to get a non-b without going to an embassy or consulate. Since your are teaching you don't need a work permit application before getting the non-b. If you can get all the required documents from your new employer you could get the B visa without needing to get a tourist visa.

If you don't get the 7 day extension you will have to leave the country on the same day your extension is cancelled.

Im a bit confused. Sorry.

So ill be given 7 days to get a work permit.. But before ill get the work permit i would need to apply for non b again. What if within 7 days i can get my non b succesfuly, then my visa would be extended for 3 months again right? By then i can apply for work permit without worrying about the 7 days stay.. Right?

Theres an embassy at bkk, as far as i remember, we can go there with my employer to apply for non b after we cancel my old work permit, cant we?.

If you can get the work permit within the 7 day extension you could apply for a new extension of stay (not a visa).

It is not possible to get a B visa within Thailand unless you have a visa exempt or tourist visa entry to convert to a non immigrant visa entry by meeting the requirements for an extension of stay at immigration.

There is no embassy in the country.

along with the new contract and all documents of the new employer,

your old WP will be automatically cancelledm and run the new one,

Additional info:

Any type of Visas could be tranferred to another employer as long as the same time, Non-B , or Non-ED if you are study in a school or university then you decided to move to a new one, I have done this before,

It is not possible to apply for a non-b visa only an extension of stay. Immigration does not issue visas unless it is part of a conversion to a non immigrant visa.

Once you are in the country you do not have a visa you have a permit to stay.

It is not matter of transferring anything it applying for a new extension of stay after the previous one is cancelled or expired.

I'm sorry, but this information is already a few years old.

Was in a similar situation and they'd have been okay, if the school's in the same province. best would be to ask them. Good luck.-wai2.gif

Being in the same province is a must. If leaving a school on friendly terms and they will cooperate in applying for a work permit for the new school it can make things go a lot smoother.

I might be wrong and I don't know what is happening right now, but I knew a teacher who just simply kept his old work permit and changed the name to a new school at the labour ministry. What happened is, the school in Ranong didn't cancel his work permit so he had lots of time to change the school name in his work permit in Nonthaburi. He did that without leaving Thailand.

In general I agree with Ubon Joe.

But please be aware, that formally the WP is issued to the employer (or school), not to the person working there. So only the employer can (and actually must) return the WP within 7 days after the end of the working contract.

Now it could be possible, that the Labour Department allows to switch the company or school and just change the relevant data in the WP, but so far I have never heard of such a case.

And the visa is a different thing as well.

I doubt very much, that immigration can change the type of visa, because the Immigration does not issue visas. Immigration comes under the Police and that under the Ministry of Interior, while the embassies and consulates come under the Ministry of Foreign Affairs.

Extension of stay can be done by the Immigration, but that is about all they can do...

The work permit belongs to the employee, who is the applicant. Many employers like to keep on to it because of various reasons, but the WP belongs to the emloyee and he must be able to show it at the place of work. The employer can also be fined.
