Popular Post Showbags
We have this block of land we just started work on yesterday...last week we struck a deal with the neighbours which was good for all of us, especially them. What it involved was a road which ran down the length of our blocks boundary of some 50m long. Currently this road is on their land entirley, we needed to have a road down this section which we could use as we intend to sell the land. So we struck a deal to make the road half on their land and half on ours, we pay for the Makro to move the road over, any more dirt required we paid for and stone for the surface we paid for and constructed. The important thing is here that they get use of circa 50 wah of their own land back...for nothing. We agreed to have this road then gazetted as a government road, so we both give up ownership of it, but the government then raises the road and more stone etc, plus puts in the electric poles. We were happy with this as we both wanted this access for future selling of the land for subdivision etc. Yesterday the Makro arrives and the neighbours change their mind about us taking half the dirt from the road and using it to complete the road on our side, they wanted us to add to the roads width with dirt dug from our place and we pay for it all of course. Told them to shuv it, decision was made on the spot to make the road WE need on our land, fence them off and be done with it. They do not get to reclaim their 50 odd wah of land. Further...we have approximately 60sq metres of land on our side which we have made a drain for them to get water for their rice...which obviously travels across our land and we cannot use that 60m or more, for anything. Guess who is not going to have water this season to grow rice because of their narrow minded ignorant short sighted attitude. xxxxxxxxxxxxx Edited January 30, 2014 by Rooo Topic title & profanity.

If he builds a road (without permission) on his neighbor's property then he's trespassing... methinks you are misreading the post. the road runs up his boundary. All he has to do is build a road beside their road.
CharlieH
Make it clear the road is now on your land, if they use it or cross it ( to access water etc) they are trespassing. I hope I am wrong, but I feel this is not over and there will be further developments at some point. Best of luck.

Not violence. But, as Joe Cocker would say, We get by with a little help from our friends (and neighbors). There's a thousand ways that having good relationships with neighbors will improve quality of life, and hundreds of ways that a bad relationship with our neighbors can really make life more difficult. One day, we all need a favor. Like, for example, the day the surveyors come out and inform you that you built your fence 4 inches over the line onto your neighbor's property. Or a road, perhaps. BTW, I know Joe wasn't the first to sing the song, but I like his the best.

So you build the road, what is the problem? He makes less money if he ever sells the smaller sized land (illegally). There's a couple for you. Showbags
We have access and we have water and we have chanote titles with already defined and approved boundaries...so no issue there. By simply building the road half on their land and half on ours...we both win and at absolutely no cost to them and they get 50/60 wah of land back. Now, as we have done today, we build the road on our land only, so we lose a little and yes a little less to sell...maybe...but I have a plan for that. Big issue is that they lose their water as we have let it run down another boundary, around a corner and over into their land....this used up about a 1 metre wide drain for 50/60m's...we will tomorrow while the Makro is still there...be leveling that drain and getting that 1m wide strip back to plant trees. Unfortunately they will have to buy rice to eat this year.

Popular Post impulse
You probably can't legally affect the water rights of the folks downstream. Plug up their water supply (especially if it predates your ownership of your land) and I'll bet you'll wish you hadn't.
