Court ruling on Feb 2 poll attracts criticism

So it was Article 108, after all. The " independent law academic " quoted here is wrong in the application of the 180 days. That takes effect if a 95 % quorum is not reached due to the nullification of winning candidates if they won due to campaign infractions determined afterwards by the EC, as in all previous elections. But in this case, eight provinces were completely missing on election day. Unprecedented. And any further polling days would have been in breach of Article 108. The election was held without all regions of the country represented, and was placed in the position of having to have sequel election days. Therefore, it was unconstitutional. But at the end of the day, the armchair quarterbacks take a back seat. The Constitutional Court has spoken. Period.

Regardless of the out come, how about concentrating on the issue , how/when are you going to hold elections, how are you going to prevent the winners of that election to completely monopolise the reform panel , the way forward would be to let the elected government run the country ,( err yeah), and a independent reform panel , with no politicians , no government Department heads , no party hacks, lead by no other than General Prayuth and manned by respected people from the community, then a general review , then a people's vote, two years duration.coffee1.gif That's a start, u can fill in the details , I am tired of the whole BS.

After this ruling elections are pointless, all any dissenting group has to do is shut a few voting booths and the election will be nullified.

Simplistically say the Democrats start gaining much popularity and decide to participate in an election, all any of the opposition who think they are going to lose have to do is prevent voting in a few areas and it will be void.

It is complete madness, and regardless of your political preference, anyone must be able to see the crazy precedent this ruling sets.

well all those concerned have to do is convince all the Thai people that the whole country is ready for an election and then it can proceed - right now a fairly high proportion of the people are saying no and my guess is that is well above 50%, maybe they should have a referendum asking all the people if they are ready for an election at this time

Why not, the CC have already ruled that a referendum was necessary before any amendments to the constitution were made despite there being no such ruling in the constitution. Why not insist on a referendum before an election, it's not in the constitution but hey, that doesn't bother the CC, it's how they interpret the constitution that counts.

Why not have a referendum about having a referendum?

How can anybody justify this ludicrous ruling?

How can a reform panel be independent if it is lead by General Prayuth??? This is someone who played a key role in the 2010 crackdown and the 2006 coup (and has been threatening to do it all over again). He is nothing but a yellow pawn.

Get your facts straight. If anything the general has dismissed the idea of a coup. At the most he has not ruled it out and i believe this was only said to deter the reds from acting crazy with fire in the hands and blood in their eyes

Prayuth could have done a coup at any time yet has shown reserve and from his actions has shown to be unbiased and upholding the RTA vows to protect the country, the people, and the monarchy. Your claims that he is a yellow pawn is extremely biased and unfounded which leads me to believe you are seeing RED and not seeing clearly.

Prayuth has been protecting Sutheps protesters because they have been the center of almost all of the attacks. Prayuth has spoken out against your Reds only when they posed a clear and present danger to this country with their talk of taking arms and seceeding from thailand.

So before you start spouting your red propaganda look at the facts and the logic prayutha had used.

You might want to study Thai military history with particular reference to classes and regiments, and then rethink your post, at the very least.

I have been reading Thai VIsa Forum for about 5 years but never signed up. I have been reading a lot more lately and decided to sign up. I can sit on a bean bag with a pot of good coffee coffee1.gif and read all the the posts all day long getting entertained and not finish all of them. To all those who wish to cheer this judgment, remember that the vote was 6:3 so there are 3 Constitutional Court judges who disagree with this ruling.

The ruling as it stands can easily be challenged.

Why does not The Nation brilliant reporters write about the reasons as to why the 3 dissenting judges voted the way they did?

A good question. When the first of two dissolution cases against the Democrats was defeated on a technicality, they printed each individual Judges ruling

No matter what the courts decided they would have parties disagreeing with them. A lose lose situation.

Being that they followed the constitution by the letter without regard to circumstances shows impartiality. Circumstances should never be a viable excuse to go against the law.

Unfortunately Jatuporn and his Red Brigade don't see it this way and feel exceptions should be allowed as long as they favor the PTP party.

If it had been ruled a legal election the UDD and PTP would be screaming foul if the results showed they didnt win.

The judges had better start watching their backs now as the crazies are converging again for something big.

Re-read the article, you appear to have not comprehended it.

The court disregarded the constitution and did the yellows dirty work. Better Suthep and his mob be upset for for courts being impartial than the majority of the population being upset because the courts are trampling the system.

The judges don't need to watch their backs, they just need to shuffle off to pasture, their time is up.

How can anyone in the right frame of mind question this perfectly legal ruling? Anyone with an ounce of grey matter could predict the outcome based on all sorts of illegalities taking place throughout the campaign and during the election.

Incidentally, you can take your sanitary napkin with you and leave it in front of the Constitutional court to show your strong disagreement with their decision. That would be a very classy act. Same as the stunt performed in front of the NACC. After that disgusting performance the expression a red shirt supporter has been slightly changed. Erase the letter 'r'. You'll figure it out. Hilarious.

I was trying to point out to you what the allegiances are in the Army and why. Once you understand the schisms within the army you will realise what influence they have on Prayuths actions. At the very least reflect on the regiments that were used in 2010 against the UDD and who wasn't - you might even be able to work out why, but I doubt it judging by your indifference to being told something that may help your understanding of the present situation..

i read the posts with interest, valid points on both sides, i see the courts have ruled the voting in Feb invalid, so my thoughts are all the "other"side who ever they might be, just have to show up - create a disturbance and hey ho there will never be another election ever. ?? and so the saga rolls on .

I would hazard a guess that it is also the view of a vast majority of the world's legal scholars that have been following event s in Thailand.

The courts verdict has utterly destroyed what remained of its reputation.

that would be correct *if* the judges were neutral and respected and served only the constitution and the rule of law, and not "elite" yellow shirt interests.

considering their track record of these mostly military installed judges since the 2006 coup...... thats a very big if.

I would hazard a guess that they think that this government has acted democratically!!

If that is the case then their views mean absolutely nothing as they don't understand what has been going on for the past two+ years in Thailand!!! Either that, or they don't want to know!!
