webfact Posted April 3, 2014 Share Posted April 3, 2014 PM pleads for fair treatment of her casesBANGKOK: -- Caretaker Prime Minister Yingluck Shinawatra pleaded with the independent agencies to treat her cases fairly and to apply the same standard in treating the cases.She made the above remark in apparent reference to two cases pending against her with the National Anti-Corruption Commission and the Constitutional Court. She is facing an investigation by the NACC for alleged negligence of duty regarding the rice pledging scheme and, in the meantime, is facing an enquiry by the Constitutional Court for the removal of Mr Thawil Pliensri as the chief of the National Security Council two years ago.She said that if everything was done according to the letters of the law and no double standard practice was used in the two cases against her, the judgements of both the charter court and the NACC would be acceptable by the public.The prime minister declined to comment on the question that it appeared that her cases were quickly wrapped up saying that in her capacity as the accused, she would not comment on it.Regarding the case with the NACC, she admitted that she felt heavyhearted because the NACC allowed only three more witnesses to testify instead of 11 that she had demanded. In stead of visiting an acquarium(photo op), how about working on your defense or trying to solve the problem of paying the farmers. She has asked the agency to question 11 more witnesses, but the NACC allowed only three of them to testify before Songkran begins on April 12.With a limited timeframe and a reduced number of witness, Ms Yingluck said she is worried by the matter but will use existing mechanisms to defend herself to the utmost.She insisted that the allegations against her are untrue.Following the Constitutional Court's decision to consider a petition against her over alleged unconstitutional transfer of National Security Council (NSC) chief Thawil Pliensri to an inactive post, Ms Yingluck expressed hope that the court will apply the so-called one standard practice to rule the case.Ms Yingluck pledged that she followed all procedures in transferring Mr Thawil.The Supreme Administrative Court ruled last month that the removal of Mr Thawil from his previous NSC post was unlawful and ordered to reinstate Mr Thawil in 45 days. A group of 28 senators led by Paiboon Nititawan later petitioned the Constitution Court to rule on the status of Ms Yingluck and whether she has breached the constitution in the case. It is not the fact you followed the procedures, it is because of WHY you did it in the first place. The Constitutional Court has no other choice than to find you guilty as charged, or they will have to go completely against the administrative court and the supreme administrative court rulings, and that would probably undo their rulings, and Thawil will probably have to be removed again as the finding was in your favour. The constitutional court will never do that in a million years, because they know those courts considered all the evidence for over 2 years and returned their findings. Tut Tut.... you are gone, gone and gone....... Don't even bother about the NACC case any more. It is now no longer relevant to your status. Nepotism is illegal under this constitutional democracy that you purport to fight for. As an aside she might have mentioned that her cabinet member caretaker Dept. MoC Nattawut assured her that the existing mechanisms were being oiled to ensure proper functioning when required. " How ? The Administrative Court found it unlawful last May. The Supreme Administrative Court in a final decision this week found it unlawful. Unanimously. How can you say say that the transfer was in line with the legal process when the constitutionally empowered courts say it is not ? Did you not hear their verdicts ? What part of the word " unlawful " don't you understand ? There are graceful ways to leave. And then there is this. It seems not one day passes without a statement from either Yingluck or some other Pheu Thai official that smacks of trying to get people to distrust the judicial process in some way, shape or form. Pheu Thai is conducting a not so subliminal campaign of asides and comments that are clearly designed to sow doubt in the judicial process. It's insidious. I thought under the law your entitled to a fair go. Looking a bit like a kangaroo court to me with the restraints that are being put on her defense. Now that the CC have got off their ass, along with the NACC and they both seem to now understand the difference between their ass and their elbow, they can see they CAN do something for this country. Or to plead with them to treat the PM with 'fairness'.... All they got back in reply was a BIG FAT SILENCE. The west can see all too clearly what is going on here, and what has been going on here. I expected at least a stock 'off the shelf' reply saying to please maintain peaceful and respect democracy and the rule of law..... They didn't even issue that. To me and to this shambles of a government. That silence speaks volumes about the current attitude of the international community. They don't agree with this government, and they sure as hell won't be getting involved in what is clear to them, 'correct judicial procedures in accordance with true democracy'... Their silence is deafening. The PTP, Cabinet and the UDD/reds are an island. They have zero support outside of their silly little tin pot regime. If they want to rise up in a civil war, they will see the true feelings of the hot tempered Thai people in action. They have declared a war on the PDRC Independent agencies The Military. This lady and her supporters are now attempting to appeal decisions also; which have not gone to their satisfaction using the same methods, as well as a few, what some consider threats toward those involved by, what some call thugs. We may be watching the progression of a complete diisregard for the judical, and legal sytem by this caretaker government. As a final observation, if the caretaker PM had kept abreast of the shannigans /corruption going on under her ''chairmanship', leadership'' as she has judical proceedings, which are of concern to her, she would not be in the position she has brought on herself. No agency or court in the world will allow irrelevant witnesses to be brought in. If they are not connected in any way with the rice scheme, then how the hell can they possibly be witness to anything? She is just stalling for time and trying to stack her case with false witnesses and fake evidence. It really is an open and shut case.... She was not only the PM, but also the chairman of the rice scheme, it is her responsibility to make sure that it is run correctly without corruption, she failed to do so even with the most compelling of warnings from local to international levels of massive corruption going on and yet she did nothing......, and in any country in the world is clear negligence. What is the betting that these witnesses will come bearing evidence that she instructed particular departments and people to stop the corruption with paperwork back dated to prove this (which will all be fake documents). But she is wasting her time... This is not going to hang her. The other case is what is going to do that.and the whole cabinet will be gone too. Good riddance. Because the other 8 are going to say the same thing - she wasn't at many of the meetings so couldn't have been involved with the corruption. But she is chairwoman of the Rice Scam so the buck stops with her, she can't blame anyone else. If I was defending charges of this magnitude I would expect to mount the best defense I could.
