Hi there could anyone help clear this up for me. Just getting a bit stressed as it's coming up soon.

Wife came here in August 2010 first time on 2 year settlement. When this ran out she applied for 2 year FLR which will run out this August. She has now completed ESOL level 1 and 2 and will finish level 3 in June. Also she has life in the UK test pass. My wife thinks she has to have the level 3 before she can apply but I thought it can be any level but have to have a completed life in the UK aswell.

Also could anyone tell me is it just the normal SET M application form that she will need to complete?

Thanks in advance if anyone can clear this up.

First the good news: yes, it is form SET(M) which she completes; I'd also recommend using the Settlement checking service.

Now the bad.

Since October last year applicants for ILR have had to pass the LitUK test and achieved B1, or the equivalent, in English speaking and listening from an approved provider.

If her current course meets this requirement and she passes the test at the end; fine. If not, she'll need to arrange and pass an appropriate test before August; otherwise she'll have to make another FLR application.

Hi thanks 7by7. Good news about the SET M form. The college where she studies is an accredited college. But what s the equivilant to B1 English? As she has ESOL entry level 1 and 2 already which is also reading and listening. We will wait until she has the level 3 certificate anyway just to make sure.

When we applied for her FLR we were there in person at UKBA in Liverpool. We did the application ourselves. Is there a need to use a visa checkiing service? Is it expensive?If we apply by post and there is something wrong with her applying for ILR will they let her change it to FLR? Or will they automatically cancel her visa? Hopefully i'm just over thinking things as i'm quite sure she has done what is required.

Would anyone reccomend we book an appointment and go there in person incase there are any hiccups?It is a lot more expensive to do this though. Thanks again. Looking forward to this being over and done with.

Thanks for clearing that up. All being well she will recieve the certificate for level 3 in June.

Just to make 100% sure in my head, she is definatly eligiable to apply for ILR if she has been here since 2010? Her original visa was 2 year settlment, then she got 2 year FLR and next she will apply for ILR. This is correct?

Remember you only need the speaking and listening part as normally a esol course includes reading and writing. From my understanding you did not need to wait until your FLR ended to apply for ILR you could have applied after you wife had spent 2 years in the UK as long as she had meet the requirements at that time. As your wife has her life in the UK pass and when she gets her speaking and listening certificate you can apply for ILR. Best of luck.

B1 is a grade of the Common European Framework of Reference for Languages (CEFR)

Click here for the list of Home Office approved test providers and their equivalents to B1 of the CEFR. Check with her course provider that her course and qualification at the end of it meets the requirement.

Yes, provided she meets all the requirements for ILR, including language, then she can apply for ILR once her current FLR expires, or, as MaprangHolmes says, before that if she has met the requirements.

If she hasn't met all the requirements when her current FLR expires, then she'll need to apply for FLR again.

Thanks for the replies. So if my wife has level 1 and 2 already and a UK knowledge and life pass she can apply now? Or do.you.mean she could of up until the rules changed? Our intention was for to apply for ILR 2 years ago but she didn't get the letter off her college backing up her certificates. As we were there in person they said she wasn't allowed to.apply for ILR so that's why she ended up applying for FLR. Thanks again for the help.

More expensive, yes, but my wife and I were happy with the same day service.

There'll be no hiccups if SET(M) is completed correctly, signed and dated and accompanied by the requisite qualifications and documentation.

Digest the guidance notes carefully, take your time and you'll find that ILR is a more informal affair compared to settlement visa application.

Two days after my wife's ILR application was rubber-stamped at the Home Office the Biometric Residence Permit was delivered by courier.

The same day service suited our requirements.

Your wife would have to wait until she has her level 3 level 1 &2 are below the required level.

. Ensure you get the covering letters from the college confirming the course meets the standards and then she must pass the ESOL Level 3 for speaking and listening. Best to go for PEO appointment (less stress)

A covering letter confirming course meets the requirements is no longer needed as, since October 2013, it is no longer possible to meet the requirement by progressing on an ESOL with citizenship course.

The requirement is now a LitUK pass and a B1, or equivalent, pass in English speaking and listening from an approved provider.
