Hi

After the 12 months of stress my wife has finally passed her B1 and the Lit Test.

Now on too planning for her ILR visa her current visa runs out on the 14/08/14 .

I want to try and make an appointment .

If I can get a appointment is it any time with in the 28 days before her visa runs out ?

I assume she made her initial visa application before 9/7/12 and so comes under the old rules.

If she currently holds a 27 month spouse visa the earliest she can apply is 28 days before the 2nd anniversary of her first entry to the UK using that visa. The latest is the day it expires.

If she entered as a fiancé and currently has FLR, or holds FLR for some other reason, then the earliest she can apply is 28 days before her FLR expires, the latest the day it expires.

Why make an appointment? Personally I feel that the ILR fee of £1093 is extortionate enough without paying the extra £400 to apply in person! The official advice is to allow up to 6 months for an ILR application to be processed; though anecdotal experience shows that most are done within three. So, unless she will need her passport back before that, save yourself £400 and do it by post.

Though I do recommend using the Settlement Checking Service if it's available near you.

my wife came on 02/12/11 so yes shes under the old rules .

Am i correct in saying she can apply for citizenship after 02/12/14?

she currently holds FLR and it expires mid august the reason i want to make appointment was my friends application for his wife took just under 6 months .

I want to apply for citizenship as soon as possible due to my work commitments

Once she has ILR she can apply for naturalisation if she meets all the other requirements.

The residential requirement for the spouse of a British citizen is

  • Legally in the UK on the exact day three years prior to applying.
  • During that intervening three years spent no more than 270 days out of the UK with no more than 90 days in the final year.

Just another Q on the documents in joint names / single name

I've got 4 in mine and the wife's 1 in just my wife's then ive got a mix of different letters too my wife but not all the same over the 2 years .

we moved at the end of Jan and my phone /broadband bill has been wiped off by my provider so ive only got that from Feb .

how strict are they ?

They do realise that people move house; explain this in a covering letter. As long as you have a mix of letters showing you both living at the same address at the same time covering the whole period that should be fine.

The letters should be from at least 3 different sources.

For more detail see Note 8 in Section 11 of the form.

If in doubt, as you are going to apply in person take plenty with you and they will check them and take what they need.

Just out of interest the wife's bank account she got her FLR on the 14/08/12 she got her bank account on the 8/9/12 if I applied by post which is 28 days before 14/08/14 that's not a complete 2 years will they Except this ?

I don't understand the question.

There is no requirement that an FLR or ILR applicant has a bank account; and if they do have one there is no minimum time they must have done so.

If you are asking whether or not she can use bank statements or bank letters addressed to her as evidence of cohabitation; then the answer is yes.

Sorry my Question was once my wife got her FLR in August 2012 she never got a bank account till the September 2012 .

If I was to apply for her ILR by post in July 2014 this wouldn't cover the 2 year period would it be accepted in her application ?

As I said, there is no requirement for an ILR applicant to have a bank account at all.

If you are asking whether she can use letters from her bank or bank statements as evidence of cohabitation, then the answer is yes, she can.

From form SET(M) Section 11, Note 8.

The dates of the letters or documents should spread over the whole 2 years. They should be from at least 3 different
sources.

Which means she needs a selection from at least three sources covering the whole period; not that each source has to cover the whole period.
