Child Overstay

Featured Replies

Hi, just a quick question to clarify, as I see varying accounts: at what age does immigration begin enforcing the overstay fine for children? Some pages say 15, some say 7.

Children under the age of 15 do not pay overstay fines.

Thanks, that's what I had thought. This ThaiVisa info page said the age of seven, so I wondered if maybe something had changed.

I read the similar thing - Children under 16 (i.e. 15 years or younger) don't pay the fine and can't be prosecuted for over stay.

I looked into this deeply, recently I was unable to get my Son's passport and considered departing Thailand and re-entering on his UK passport thus entering him into infinite overstay period (which I didn't need to worry about for the first 15 years !).

Last time I had my 2 yr old daughter(Filipino Passport) here she overstayed 3 times back to back. Overstay when I took her to Laos and Cambodia then 3rd overstay when she left for Philippines. The immigration officers didn't bat an eye. Also no red stamps either.

It is under 15. The day a child turns 15 is the first day the fine for overstay commences.

If a one has Thai nationality but enters on a foreign passport, 1 year extensions of stay can be gotten very easily upon proof of Thai nationailty.

But WHY do you make your own child overstayed ? I don't understand it at all.

Don't play with kid's rights!

Why would you waste money on a visa when there's no repercussions for their overstay. Come on use your head.

Because following the law makes it easier and you can't guarentee the rules will change in the future and it does become a problem.

Are kids fined for not doing 90 day reporting?

That is a qustion I don't know the answer to.

But an educated guess would say "no". The law limits (criminal) liability of minors under 15 years old, probably one of the reasons (if not they reason) why there is no overstay fine for them. The same would probably go regarding other fines, such as not reporting.
