Thai men in Melbourne Court for Murder.

Sarud Seehaverachart, 31, and dual Thai-Australian citizen Thatiya Terdputham, 38 have finally appeared in the Melbourne Magistrates Court for a committal hearing after being extradited from Thailand for the murder of Luke Mitchell.

A witness says he saw an Asian man pull a knife from the body of a Melbourne man who was beaten to the ground and murdered outside a convenience store.

Luke Mitchell, 29, was fatally stabbed at a 7/Eleven store in Brunswick, just minutes after a confrontation with a group of men on the popular Sydney Road night-life strip.

Witnesses described seeing a group of up to five Asian men pile out of a car which had screeched into the store's car park to launch a lightning fast attack on Mr Mitchell.

Thai national Sarud Seehaverachart, 31, and dual Thai-Australian citizen Thatiya Terdputham, 38, are charged with Mr Mitchell's murder in May 2009.

John Kostantinakos told the Melbourne Magistrates Court he was sitting in his parked car outside the store when men attacked Mr Mitchell.

He said Mr Mitchell saw the men charging at him and tried to flee past his car, before being knocked to the ground.

"One of them put his hand on the roof of my car and jumped up to kick him in the face," Mr Kostantinakos said on Tuesday.

Doesn't sound like it was random or spur of the moment but premeditated.

Well done Australian detective for finding the alleged perpetrators.

It definitely wasn't random. He interfered when 2 thai guys were kicking the life out of another guy. He broke up the fight and proceeded to walk home. The Thais apparently didn't take to kindly to that and went to get reinforcements and arm themselves.

Mr Mitchell, 29, was attacked five times by a group of men outside a 7-Eleven store at the corner of Brunswick Road and Royal Parade in Brunswick about 2am in May, 2009, as his sister-in-law and her friends watched.

The good Samaritan was stabbed a short distance from where he stepped in to break up a fight outside a nightclub.

Have been following this story and saw it on the news again today. These two have a huge hurdle to jump. I know it is only the commital but that is just a formality. They initially claimed self defence, well that may work in a Thai court but not a professional court like in Melbourne. They have put themselves at the scene by claiming the self defence routine. Witness testimony says a number of guys pulled up in a vehicle and rushed at him and proven armed as he was stabbed to death. The guy was not expecting it and tried to run, that is not self defence, there was serious intent to inflict maximum damage if you plunged a knife into a person a number of times. They then fled the country back to Thailand. The identity of the 3rd guy is apparently known and he is apparently very well connected in Thailand. The 2 in custody claim they don,t know him but went and sought his assistance to get revenge on the Aussie and they claim it was the 3rd guy who actually killed the victim.

They may also get a shock when they realise they cannot bribe their way out of it.

They definitely won't buy thier way out of it. They already tried the old, Australians are racist towards Thai's and they won't get a fair trial.

It seems connection have changed a little in Thailand. May be worth another try at getting him back to Australia. THat would give him a shock.

Fair point with the military trying to win hearts and souls it is the perfect opportunity.

yes, once again we see the thai males way of fighting, several onto one and using weapons then running away like the scum they are. Lets hope they are thrown in jail for many years and the other culprit is also caught, the thai laws really need to change and these group bashers need to start spending serious time locked up instead of being made out to be "heroes" by the male populace. This will be a great chance to see just how fair the thai laws are supposed to be now with all the changes, no more protection for the rich, just maybe we will start to see "rich" or "connected" people start to do time.

I don't think it will happen.

As a member of Victoria Police and personally attached to a member involved in the initial case, under the current Thai administration I doubt if he will be handed over. Hats off to them and total admiration if they do.

Blame that on the legal system. Thai law is built around the premise that if you kill someone alone you're an evil murderer who should go to jail/be executed, if you kill someone in a group then you're a victim of mob mentality and you can get away with a lesser sentence or even just a fine of up to 4000 baht.

Third man involved in Luke Mitchell stabbing, court told

One of the two Thai nationals accused of fatally stabbing a man outside a Brunswick convenience store confessed to an inmate in a Bangkok jail that he stabbed Luke Mitchell but his co-accused did not, a court has heard.

Gregory John Dunn was arrested in Thailand in 2012 on fraud charges and told Melbourne Magistrates Court on Wednesday that while in a Bangkok jail awaiting extradition to Australia he was an inmate of both Thatiya Terdputham and Sarud Seehaverachart, who are both charged with Mr Mitchell's murder.

Dunn told the court that Mr Terdputham had claimed to him that he and another man, who remains at large, had stabbed Mr Mitchell in the early hours of May 24, 2009, outside the 7-Eleven store in Sydney Road.

SO... to get this straight! They were arrested in Thailand when? 2009? Spent time in Bangkok prison, then extradited in 2014? So they have spent 5 years in prison over here already? I think they just want a prison upgrade if that is the case.

doesn't matter if this Sarud character actually plunged the knife into the victims chest or not, he is still just as responsible. It was premeditated as they went looking for the victim and attacked him with weapons. It is alleged that the victim was held down whilst being stabbed and assisting by holding him down whilst another stabs him make you just as guilty. Melbourne is a long way from Thailand and this story may get you off there but won't cut it in the real world.

If Thailand wants good relations with Oz then it should be told they serve their life sentence in Thai prison

They will not last in an Aussie prison. Been there done that .

What cos they stabbed an Aussie? The days of Aussies runnin the boob are all over, it's all Lebs and Viets and Koori's and give ups he will be getting his milk every morning saying "thanks chief" hittin the yard and cookin up a stir fry on the block with the rest of the asians just before lockup. It would be pure luxury for a Thai getting sent to an Aussie nick unless one of his mates have been pinched who is gonna square up for him..

I think their mentality was still in thai mode. Bloody farang interfering in the Thai custom of multiple people bashing one person. They didn't realise they were no longer beating the life out of a farang in thailand
