Hi all

I have been offered a full time consultant role for APAC by a north american firm who do not have an entity outside of the US.

I plan to reside in BKK and leave the country regularly for meetings in other countries (although will be in BKK for 6 months of the year). I will not work or gain money from Thailand or Thai companies just help market the products to thai and other asian companies... All transactions between asian companies and US HQ. I plan just to live in BKK with Thai wife (we currently live in UK) and our child.

Very confused about which Visa i should apply for and how i will be taxed in Thailand. Please help!

You would apply for a non-immigrant visa Class B, if you want to work in Thailand.

The company will have to open an entity (for example rep office) in Thailand to employ you legally.

thanks for the reply. I wouldnt actually be working or employed in thailand. The company has no office or legal entity in thailand and i would be a consultant helping them in asia, just home with wife and daughter would be in thailand. Does that make any difference? Pay would not enter thailand bank acc's.

If you did this while being in Thailand, you would officially need a work permit.

You will not be able to obtain a visa for reasons of work.

You will be able to obtain a non-O visa because your Thai wife and child.

you have two main ways to go, either 1. a '12 month extension of stay' reason by way of marriage together with a multiple re-entry permit or 2. a '12 month multiple entry non-o visa' [this is good for any number of stays of up to 90 days at a time for the whole 12 months].

I guess the grey area is what is considered as 'working' in thailand. Emails and meetings asia wide inc. thailand considered working? Or is actually going to an office, receiving a salary and transacting funds to a thai company deemed as working??

There is no finite answer, depends on who you ask.

Asking here will only get you yes / no / "just be quiet about it" type of answers not different from the many many threads that already exists.

Very true. That said a warning is in order if you intend to have meetings and more importantly negotiations with bigger Thai customers, in which case you do need to consider setting up a rep office and getting a work permit. Your negotiating position will be seriously affected negatively should the customer enquire about you having a work permit when you don't have it. Not even mentioning the fallout following a dispute between a connected Thai customer and you. It surprises me a bit that the US company is willing to go this route with you without demanding some security of your and their legal position in the region. Regardless, good luck!

Even without a Thai company sponsoring it ? And without an accompanying work permit for entries after the first ?

I am not knowledgeable about the tax situation, but it may help other to give advice if you indicate your nationality as you may have a choice between paying income tax in your home country or in Thailand, in the latter case with accounting being done between between the two countries if your home country assesses you for global income and there is a double taxation agreement.

If I understand post #1 correctly, the OP, Alex, is also conducting business with Thai companies on behalf of the US company and the US company can show "Documents showing correspondence with business partners in Thailand" and, if required, a Thai business partner (importer, distributor, etc) can provide the documents under "Corporate documents of associated partners/companies in Thailand such as...". It is not quite clear, but I have a feeling that the consulate either one or the other requirement to be met, not both.
