Can I apply for an an Education Visa with overstay?

I'm British. I was between jobs and on my second tourist visa before sending off for a replacement passport. I figured it would be returned soon, and I'd have to pay a small amount of overstay. I've since found out it could take up to 9 weeks, which would put me up to 60 days overstay. Is it possible to apply for an Education Visa while on overstay? I ask because my school said it will take a month to apply with the ministry of education, and so if I apply now, I could leave the country when I get my passport, apply for a visa in Vientiane and then return on an education visa. My other option is to apply for another tourist visa as soon as my passport comes back, and then try to sort the education visa. I've heard it's only a problem if you have four tourist visas back to back, but the third one should be okay. I understand the rules are changing and no one is 100% sure what's happening, but any recommendation or advice would be much appreciated. Thanks in advance.

Trying to get your chronology straight here. I assume that your passport renewal was submitted at VFS on Soi 11 and you still have an unexpired passport in your possession? Or, have you sent your passport renewal application to Liverpool under the old (short and quickly superceded) procedure?

Is your TR visa a single entry? When does it expire?

Have you already applied for the new passport? Is your passport full or expiring?

If it is expiring you can get a 12 month extension if you have 3 empty pages at the embassy.

If you have not applied yet and your passport is not full you should take care of your visa situation before making the application.

Yes, I applied at VFS at the Trendy Tower on Soi 13 on the 9th of June, it's full (completely) not expiring. I had a job and was planning on getting a work visa with them, but it didn't work out so I never got the visa. I applied for a double entry tourist visa, I never used the second entry, but I did extend it. It expired on the 30th of June. This means if my passport is processed in 6 to 9 weeks, it will be here well before the 28th of September (my 90 day limit). But you see why I'm worrying about whether I should apply for an education visa now, with overstay, or try to apply out of the country and get them to send me the details. I worry if I go out for another tourist visa so I can give myself time to apply for the education visa, I won't be let in, so I'm in a bit of a bind!

Try getting an emergency passport and sort out the overstay and get an ED-visa.

You can only get the ED-visa outside of Thailand.

You are stuck until you get your new passport. You should contact the embassy to see if they and speed up your passport. Info posted in the UK passport topic indicates that they can help by contacting the passport office. There is the option of getting a emergency travel document also.

You could enroll in a school so they you will be able to go out for the ED vivas as soon as you get your passport.

Emergency passport is normaly only for returning home country , and only a paper page ( "laissez passer ") (let tru ) At least in my home country Embassy rules

It depends on the country.

I had my US passport back in a week and that was without asking for expedited option. My point is that you really need to see if you can speed up your new passport process. Did you ask for special services (yes, you would pay extra)..

Because you have applied for a replacement passport already, it means your current passport is no longer valid for travel. You are allowed to keep it for ID purposes in Thailand. All the rules and estimated application timescales are on the HMPO website. Good luck.

And you are racking up 500b a day overstay charges (maximum 20,000baht) also IF your passport is not back before August 11 and you go OVER 90 days overstay you may be blacklisted for one year. Good old UK government. Masters of cocking up things. And it's not as if it's the cheapest passport service either !
