Not familiar with visa issue, need advice. Please help.

My friend is on a Non-B visa from Hong Kong and it's due to expire next month. He's actually setting up his business and will organize a work permit for himself. What is the best way to deal with his case?
Is it okay to do a visa run before his Non-B expire? Will he be able to get back in? Then is he required to leave again to apply for the work permit?

Since he can't "setup his own business" so quickly, thing that is costly and complicated, he will need to leave and return with a new visa.

Application for a work permit can be done with any visa.

 

Does he have a single or multiple non-B right now?

 

probably a single, which means he needs to get a new non-B visa. With the new non-B visa he can apply for a work permit once the paperwork is in order.

He can not apply because, among other things, he doesn't have a work permit.

No, he does not need an extension to apply for a Work Permit. 

Work Permit application can be done while being on any visa, the approval also, but the permit is not materially issued unless you have a non-imm. B.

As indicated before. On or before that date he will need to have left country, and come back with a new visa, preferably non-imm B.

Bit strange, but if you want to work in Thailand (not as a teacher), you need to have successfully applied for a Work Permit to first apply outside of Thailand for a fresh Non Immigrant 'B' Visa, you cannot collect your Work Permit until you have a 90 day Non 'B' admission stamp in your passport.

 

Just to further confuse, there are also some reports of successful Non 'B' applications being made in Singapore without a WP Application being successfully filed first.

 

Without a WP, at this stage, the best your friend can hope for is another 90 day single entry non 'b'.

Was posting about non 'b's for WP applications in Thailand, as per the OP's question.

 

To get a non 'b' on the basis of 'doing business ' in Thailand, normally you need to show evidence that you are employed outside of Thailand and of connections from your company to Thai companies.

 

To further qualify, for the aim of working in Thailand, it is unusual to find a Thai Consular facility in SE Asia that will issue a non immigrant 'b' visa with out a Letter of Acceptance (issued as a consequence of a successful WP application filing) from your local Thai Labour Department, or that you are a Teacher.

 

It is not unusual to be able to get a single non immigrant 'B' visa (or sometimes even a One year Multiple) without a Letter of Acceptance at a Thai Consular Facility outside of SE Asia.
