Today's Bangkok post mentions restrictions for building would be intooduced over 150 metres - and even then you can build but no more than 6 metres in height and each development plot limited to 75 sq metres .

So what happened to 80 metres ?

I imagine that as this is not law yet the limit of 80 metres was discussed and has now been refined , with 150 metres been seen as a more sensible compromise - considering Samui's layout .

Anyone have any other information on this ?

Actually the Enviromet controll have set it as 80 meters.

The forestry department want to claim all land above 150 meters as natural forest. and limit all constructions untill that hight.

They allso limit the size of construction on hill tops to 75sqm.

At any case who ever buys a hilltop land must check all the relevant laws that apply as in the case above sometimes 2 goverment agancies can set 2 different standards.

Who is Enviromet control and what authority do they have . What everyone wants to know is the law - how can 2 different agencies be acting in opposite directions . As the law stands at the moment one can buy land over 80 metres and obtain building permission . Is this going to change and if it does will it be enforced . It seems that if different agencies have different rules one would go to the agency with the rules that suit you ! Highdiver you seem to know what you are talking about , but where do you get your information ? It would be helpful to many people who have bought plots of land with a view to building a home for their retirement if this information was made more publically availiable .

In thailand the land its uses and building controlls are set by different govermant agencies.

For historical reasons in some cases there are overlaping rules and regulations.

Its the same in most countries that one hand of the govermant does not know the other hand.

In this case we are discussing the standards concerning the 80 meter line was intoduced by the Envitomental controll agency. they are responsible for contorling all enviromental aspects in Thailand.

In a meeting they had in Samui they intoduced this new restriction as a method to controll the enviromental impact of the over development of Samui, land erosion and to conserve the Natural look of Samui.

In todays post it relates to a differnt goverment agency. the Forest department. who is responsible of all the forests in Thailand. As such they are responsible by law to take care of all the lands that are govermant lands unless the lands are contorled by another govermant agancy.

The claim is that the forest department has susspition that the new PEAK project in Bophud has encroached or has taken over govermant lands.

They would like to check this out and at the same time are offering a new standard that construction will be permited only up to 150 meters. As they wish to conserve the forests.

So there are 2 goverment agancies, each attempting to pass a new standard based on 2 different incentives.

the amazing thing is that the final decision is made by the ministry of the interior. ;land use and development department and signed by the minister. who in return can accept deny or come up with new regulations.

If you buy a hill top land it does not say you can build what you want. you need to obtain a building permit from the Tasaban. if you have a building permit you can buid even if the law later changes. but.... if you buy land and the building controll act is changed then there is a chance that you will not be able to construct or you may have limitations you did not expact when you bought the land.

This point is many times left out buy eager lawyers who cant wait for you to buy land and set up company.

If you find this intresting then I suggest you ask your lawyer to get you the Thailand land code act translated into english. and the thailand comercial code. it makes a very intresting reading.

then go to the TASABAN in Nathong and ask them to give you the new building controll act. (IT is in Thai) and have a look at the new building zoning plan and figure out if you can build on your land and under what restrictions.

In todays Nation;

Research by the Agency for Real Estate Affairs indicates the new city plan on Koh Samui will mandate that property projects cannot be constructed higher than 150 metres above sea level.

Foreign developers on Samui suspend work because of new height restrictions and uncertainty in amended act.
