OK bit of a strange one I know but......... to cut a long story short....

marraige in uk ***** up.....

came to Thailand just under 2yrs ago for a break...

zero contact since.......

now i have a child on the way ( 5/6 mnth away)

I am led to beleive for my child to obtain uk citizenship the baby has to be legimate (i.e parents have to married) .......

this i have no objection in doing BUT how do i find out if im married still back in blighty without talking to the ex?

bigamy???

advice really required.

Well, divorce does not automatically occur in the UK. If you havn't filed for divorce, then you will still be married unless your ex has filed for divorce - and that divorce has been granted. I seem to recall that she can only file for divorce on grounds of desertion by you. And that this period of desertion must be at least 2 years.

Also, you cannot petition for divorce on these grounds because I don't think she has deserted you! You might have a problem getting a divorce if she doesn;t agree to it on the grounds of living apart for 2 years.

In any case, even if you agree on everything, I think 6 months to wrap this all up is way too short, (think 1 year perhaps??)

You can still have a baby and have everything sorted legally afaik, as long as you recognise the baby on the birth certificate.

My advice is to check with the British Embassy in BKK, I'm sure they can help you out with this one.

i had been informed ( not sure if rightly or wrongly) that as long as the fathers name is one the birth certificate once the "mess" that a few of us find ourseleves in is sorted back in the UK and we do marry our pertner here that that will "legitimize" the birth and thus allow for the application of a UK passport for the child........

This indeed would appear to be the case. A change in UK citizenship law has (I believe) just come into place. I'm waiting to here more from the British embassy.

Before the change it was not possible for an illigitimate child to hold a Uk passport, unless that is, the father was a permanent resident in the UK.
