Navymen 'did not mean to disrespect court'

BANGKOK: -- Navy personnel who carried weapons into a Phuket Court compound against court regulations last week did it out of inexperience, not disrespect or contempt of court, the junta spokesman said yesterday.


Colonel Winthai Suvari said commissioned officers testifying as state witnesses against vendors allegedly violating a social order campaign were unarmed while in the courtroom.

Those carrying war weapons were non-commissioned officers waiting outside under the shade of a tree, he said.

The fully armed NCOs were returning from duty and entered the court premises just to wait for their superiors outside the courthouse.

While acknowledging court regulations prohibiting the possession and carrying of weapons, the NCOs could not just hand over their arms to court security personnel after a dispute with a senior judge, as it was against military creed for all military men not to surrender their weapons.

Based on the headline, Ithought this article would feature the Thai navymen who were found to be trafficking in humans.

possibly from the Reuters report into the RTN allegedly being involved in human trafficking, Wouldn't that be showing disrespect for the rule of law and the courts that impose the law, After 350 odd posts you would think you had some common sense....

By the way common sense is an oxymoron as sense is not common to all.

If you going to take over the country and the law then train/teach your people the very basics and you won't have numbnuts running around. The leaders should of had basic common sense to train these people in court procedures. This host goes to prove that the leaders are idiots and the buck stops with them as the are responsible for the actions of thier subordinates. Untrained leaders commanding untrained troops.

These were NCOs not ' other ranks ' so it's a little harder to excuse ' inexperience etc.

I live only a few hundred meters from an army basic training camp and many of my neighbours are NCOs and all ' instructors ' in the facility.

If NCOs don't know the rules what are they passing on other than we're the military and can do what we like, especially now ?

I'd have to agree with the fully armed NCOs entering the court premises. "Misunderstanding" and "disrespect" are not only incorrect, they are IRRELEVANT! The country is under martial law and that allows armed military to go ANYWHERE (even into a courtroom) without challenge outside their military chain of command.

General Prayut is correct in backing the soldier's behavior. Given NCPO's absolute power over ALL governmental elements (including the legal system), the Court and police should apologize to the soldiers and the NCPO for any rash criticism.

What I find more disturbing is a legal system that seems to pretend that it is operating in a democratic civilian society under a rule of law prescribed by a constitution. There is no constitution, only the NCPO crafted Interim Charter. Just because the NCPO has graciously allowed the legal system to operate unimpeded, it can at any time intercede to use its military court system and reverse any civilian court decision including the Supreme Court.

Respondeat superior. A Roman principle of Roman Law used and enforced in countries where there is Rule of LAW.

I.E. USA, British Commonwealth, etc.

How can a country without the Rule of Law allow those cases occur, let alone go unpunished?

Simple.The military has traditionally has granted itself immunity from any wrongdoings: from top to bottom.

complete nonsense: One could give his weapons to another soldier and enter to wait/report to the superior while the others wait outside with that weapon.

I think the best way to get an answer to your question would be to strike up a conversation with one of your neighbors and ask him. The only military member I know now is a nephew who is a flying officer in the Navy, but he's down in Sattahip so I can't ask him and I don't think he knows much about enlisted personnel anyway (unless they're women, that is). My thought would be that they simply never in their careers thought they might have occasion to visit a civilian court and since they were outside the building felt they could not have posed a security threat anyway. It's not a big deal and I certainly wouldn't have thought anything about it if I had been one of them. Although when I did go to a court here in Nakhon Sawan about getting a document to administer my wife's estate (turned out not to need it after all) a security guard did tell me I had to tuck my shirt in. Maybe they thought I might have a pistol stuck in my waistband concealed by the shirt tail.
