webfact Posted January 13, 2015 Posted January 13, 2015 Individuals’ rights to stop activities deemed threatening democratic rule recognized in new charterBANGKOK: -- Individuals and group of individuals will be entitled to petition the Constitutional Court to stop any activities which are deemed a threat to democratic rule or administration. The above right is enshrined in a provision of the draft new charter approved today by the Constitution Drafting Committee. The original version of the clause only recognizes the right of individuals to propose the Constitutional Court to stop such activities but after a debate in the CDC, the clause was amended to include the right of group of individuals as well. There are two channels through which the petition can be submitted to the charter court – one is through the Office of the Attorney-General and the other is that individuals or group of individuals can directly petition to the court.Source: http://englishnews.thaipbs.or.th/individuals-rights-stop-activities-deemed-threatening-democratic-rule-recognized-new-charter -- Thai PBS 2015-01-13
yellowboat Posted January 13, 2015 Posted January 13, 2015 Starting from when I say "NOW" ! And you are only allowed two do overs in a week.
Popular Post Enoon Posted January 13, 2015 Popular Post Posted January 13, 2015 A device to stop all that demonstration nonsense. Just go to the CC and they'll do it for you. (Assuming your shirt is of the correct colour). 4
candide Posted January 13, 2015 Posted January 13, 2015 They want to put everything in place so that they can make a coup without involving the army............. Wil it work? Not sure.
Popular Post zaphod reborn Posted January 13, 2015 Popular Post Posted January 13, 2015 This is typical Thai legislative nonsense. Extremely vague laws that will be misused for personal gain or political advantage. Just about any activity you can imagine falls within "a threat to democratic rule or administration". This type of legislative drafting is specifically designed to allow Thai politicians and government officials to misuse governmental processes. There is no hope or future for this country. 4

Agree to everything you say there but would add it is not limited to politicians who will benefit from such a law. There are other highly influential groups who would love to misuse government processes. I feel what's going on in Thailand at the moment is more about those other groups than about politicians. 1
chainarong Posted January 13, 2015 Posted January 13, 2015 And what happens after the individual or the organization makes a application , is the house fire bombed, do you disappear or wake up dead in the morning, Thailand is hardly the ideal place to lodge a complaint about anything , except the B/S.
visionchaser45 Posted January 13, 2015 Posted January 13, 2015 "...any activities which are deemed a threat to democratic rule or administration." I would like to see the court stop a coup, which is the main "activity" threatening democratic rule. 1

I would like to see the court stop a coup, which is the main "activity" threatening democratic rule. Will not happen ! But maybe next this present government will change it's name to ....The Democratic Rule Party.
Emster23 Posted January 13, 2015 Posted January 13, 2015 "petition the Constitutional Court to stop any activities which are deemed a threat to democratic rule or administration." So can someone petition Constitutional Court for it's activities, as the proposed Constitution seems fairly undemocratic?

Thailand fails repeatedly to write a constitution because they refuse to write laws or rules with clear intent and definition. This law will be abused again and again to screw with elected govt. The govt will fight it, and eventually there will have to be an intervention from the army,.
surangw Posted January 13, 2015 Posted January 13, 2015 rock the boat and you get thrown over board to the sharks
rickirs Posted January 13, 2015 Posted January 13, 2015 Where was the Constitutional Court when the military Junta ABOLISHED the 2007 Constitution? Where was the Constitutional Court when the military Junta CREATED its own constitution? Where was the Constitutional Court when the military Junta GRANTED itself judicial powers? Where was the Constitutional Court when the military Junta GRANTED itself AMNESTY for all its unconstitutional acts? The Constitutional Court was SILENT. The NACC was SILENT. The OAG was SILENT. The Constitutinal Court threatens democratic rule. 1
